CA deleted from 2 CRAs but not 3rd

On 4/11 I sent a DV letter for a debt my husband didn't recognize.... 

 

The CA deleted from TU and EX on 4/29 but it still remains on EQ... I disputed with EQ and it remained unchanged... Any ideas why they would do this?

When did you dispute? Ideally give them 30-45 days at least before worrying. Some creditors only update 1x/mo.

If the basis for the dispute was their failure to have deleted based on deletion with the other CRAs, then it would not be a basis for challenge of its accuracy.

 

A DV is a debt collection practices matter, with no requirement that they do anything other than cease collection on the debt until such time as they have provided the requested debt verification.  Thus, no basis for disputing the accuracy of their continued reporting.  What they voluntarily chose to do with their reporting at one CRA does not establish inaccuracy in their reporting with other CRAs,

 

Deletion of any prior reporting at one or more CRAs clearly serves a business purpose on their part, as it removes any need to provide any timely updates to those CRAs, and removes the possiibilty of addresing any furtner disputes over prior or future reporting. 

 

By retaining at one CRA, they continue to avail themselves of any pressure that continued reporting might have upon the consumer's willingness to pay the debt.

Thanks to both of you... 

 

I gave them a month before disputing with EQ... and then EQ did their investigation. The reason for dispute on EQ was "not mine", because it's not something that either of us recognized... I didn't dispute based on the fact that they deleted at the other 2, nor was I disputing something that was valid.  

 

Just seems weird they would delete from 2 and not all 3. 

 

Any advice for next steps?

I would send an ITS to the CA for violating 809(b) by continuing collection activity, and reporting false credit information.

I would recommend first sending a formal complaint to the FTC or to your local BBB before sending any intent to sue letters.

 

They are both admin processes, one sanctioned unde the FDCPA, and the other addressing their business practices, that strengthen any potential legal action, and provide information that might be useful in any such action.

It seems as though if your husband doesn't remember anything having to do with the debt, he may be a victim of ID theft. There are some things you can do to compel the blocking of this information.

If you follow these steps, you can take advantage of the federal laws that are designed to protect you from having this fraud affect your ability to obtain credit in the future.
