How am I able to file a complaint if a collection agency is not a BBB member?
The CA is...Transworld System Incorporated; PO Box 17205; Wilmington, DE 19810
I am working on cleaning up my credit reports so that I can buy a car in the fall and noticed that they had placed an 'open' charge-off which I would like to initiate a complaint upon with the BBB. However, the BBB indicates that this company, under this same address is not registered with the BBB, and, oddly enough, only has had 1 complaint filed against them in the last 3 years for billing issues.
I got to thinking that maybe this particular name has a parent company that the compaints actually go through and is indeed registered with the BBB, but, have been unsuccessful in finding info to that effect.
Does anyone have any knowledge regarding this particular company? Maybe a parent company?
It just seems like something isn't right for a collection agency to only have 1 complaint in the last 3 years.

Still not registered, but found interesting information about them on that BBB profile. There is an alert on them regarding a government action taken in 2013. In the first paragraph or two, it states: 'Expert Global Solutions Inc and its subsidaries, (including Transworld System Inc) have agreed to...' so you're right about a parent group, but still not sure how much help it will be because apparently Expert Global isn't accredited with BBB either.

It just seems like something isn't right for a collection agency to only have 1 complaint in the last 3 years. It may be a new location or address. The one in CA has 5 billing/collection complaints, but a total of 114 over the past year

I am familiar with how to file a complaint with the BBB, I just didn't know if they could help with an organization who was not a member. So, I have been doing some further research since my post here on the forum and I did find the lawsuit against Export Global Solutions via Google. They aren't members either with the BBB, so, I decided to file the complaint with the CFPB instead.
Yes, they purchased the debt from an old account with Directv.
The balance showing is $317.
I do not know the DoFD.
My complaint is that I never received a letter from Transworld before they placed it upon my credit. I see from reading the summary of the lawsuit, this is not unusual for this company.
If I can get this off, and two judgments which were placed on my credit report late last year, then I will be able to get a much needed car. I have had no means of transportation for the last 8 months and desperately need help in that area. However, this charge off and the two judgments are keeping my credit score under 630 and I need at least 630 to forgo the downpayment at a local car lot.
I'll have the judgments paid off in September and will file a Motion to Vacate on both of them. I live in Virginia and have 12 months in which to do that if the debts are paid.
This forum has been a goldmine of info. If I had not found ya'll, I would not have any hope of having decent credit.
In the last three months, thanks to this forum, I have been able to get deleted from my credit report....
Two I. C. System accounts totaling $1,316.41
One Jefferson Capital System account totaling $287.53
One early deletion of a medical judgment on my Experian account 8 months early.
So, thank all of ya'll again for the enormous amount of help and info available here!

It's actually not a violation for them to do that. They must provide you with the letter outlining your rights to DV within 5 days of contacting you. I just googled their name again with 'PFD' and nothing really came up. That alone is odd. Anyway, perhaps you can do a PFD, but first of all, you may still be able to request DV. If they never sent you a letter, then send them a DV letter stating that you only found out they were trying to collect a debt in your name when you saw it on your CR. "If" they are able to validate, then try PFD?

System is reasonable to work with and that while they won't put a PFD in writing, those who have taken a chance after being verbally told they would, have seen the accounts removed from their reports after paying. No guarantee, but what do you have to lose?

Before it was removed from the CRAs, Jefferson Capital System showed that it was first reported on 3/2012. I don't know if that was the DoFD.
JCS bought the debt from an older account at Fingerhut Direct Marketing sometime in 2012.
If the CFPB can't help me, then, I will try a PFD with Transworld.
I'm just extremely happy to be as far along as I am in regard to rebuilding good credit. :-)
I'm actaully dealing with Transworld Systems right now.
I found a collection for a parking ticket from 2012... the thing is I've never seen or heard ANYTHING about the ticket from my court, or Transworld Systems, they didn't have a copy of the ticket and just told me to call my court.
I did a search through my courts online records and no trace of the ticket appeard, I even bought a copy of my husbands driving record (it's on his CR) and nothing...
I finally called the court and they sent me a copy of the ticket. So I'm going to try to PFD, although I'm a little pi$$ed because it was a $25 ticket that I would have easily paid had I know anything about it at all, and now it's $100
The court said I should have heard from the CA, but like you, I've never seen or heard anything from them... which isn't the worst problem to have with CA.

For instance, I received an email from the CFPB this evening in regard to the complaint that I filed earlier today on Transworld System. It was letting me know that I had received a partial reply from Transworld, and this is how it read...

Okay, why is it if the letter was sent to me from Transworld, I would be expected to reply to them within 30-days, but, they are allowed to have 45 days in which to respond to my complaint?
That's not right. They should have to adhere to the same guidelines as we do.

The date it was first reported is not the DOFD by a long shot. If this is an old fingerhut account that they purchased sometime in 2012, we could be talking past SOL and possibly close to aging off of your reports entirely, depending on how long Finger hut held on to it after charge off.
If you can remember when your first late payment with fingerhut (that your account never got caught back up and led to them closing the account), THAT is your DOFD. It is normally 7 - 7 1/2 years from that month when a collection should fall off of your report.
I would make sure of that date before making any arrangements with JCS, they're known for being less than honest when it comes to the DOFD.
