I have a charge off account with a CC company that was supposed to come off my credit in 11/2008 after 7 years. This account had a DOFD of 11/2001 and they actually went in and changed the DODF to 6/2002 !!!!
I have credit reports that show the same 11/2001 date then the new and improved DOFS date on the new credit report. Thus it stays on my report. Is this illegal?????
This all started when said CC company came after me in court and served me in 1/2008. My state has 6 yr SOL for CC so they were past the date- they needed to make the 11/2007 date for 6 year SOL. Then they come in and chande the DOFD and POOF...they are within SOL.

They cannot change the DOFD. It is fixed from the date of first delinquency on the account that led to the CO or CA action. If they did change the DOFD, yes, that is illegal. Section 605(C) of the FCRA.

Did they get to sue? Did they win? What happened with that?
SOL usually goes from DOLA and not DOFD.
