Clarifying when in the month the bureaus exclude derogs

OK, I have seen this info in the past but just want to cement it in. To my recollection, when a derog hits its natural exclusion date at seven years (I'm acknowledging but ignoring the additional allowable 180 days since it seems so rare that derogs last through that), when does each bureau drop them? The way I remember it is Experian is said to drop it sometime toward the second half of the month of exclusion while TransUnion and Equifax drop on the first day of the exclusion month.  Can anyone confirm or provide contrary information?

This is big for me because I have exactly one old derog, paid off, sitting here from Eastern Account Service, who not only reneged on an oral agreement to PFD, but then told me to kick rocks when I asked about it. They have been the bane of my credit-aware life.

That derog is set to expire this coming Thursday, April 1.

I pulled my ACR reports earlier this evening (EX of course had technical difficulties as they have every time I've tried), but I was able to get Equifax and TransUnion. In the TU report, it states "this account is set for removal on 4/2021" and on Equifax the DoFD is listed as 5/2016. Being that I'm in NY and it is paid, the Purge Law sets a time-bar period of five years. That puts 4/2021 as the 60th month.

So if I'm correct on the drop dates, next Thursday my TU and EQ reports should go clean, and EX will follow later in the month. I just want to confirm this so my expectations align with reality. Anyone? TIA.

PS - I can't freakin' wait lol

Sorry I can't answer your question but have you requested early exclusion?

That could get it removed even quicker.. I believe you can call and ask for early removal.

It's worth trying..

If exclusion is being based on DOFD, then refining required exclusion end date to day of the month is too specific.

When reporting DOFD, FCRA 623(a)(5)(A) clearly specifies that only the month and year is provided.  The CRA credit reporting manual similarly defines reported DOFD only in terms of month/year of commencement of delinquency.

The ultimate exlusion under the FCRA is stated in section 605(a) as occuring once the period of delinquency antedates the DOFD by more than 7 (or 7 plus 180 days), which means the first day of the next month after the 7 (or 7 plus 180) period has expired.

No day of the month is involved in determination of the mandated exclusion date.

Each CRA uses its own internal business practices to determine when they actually will do the exclusion, but it could be anytime up to the first day of the subsequent month.

@Pikaboo-icu lol yeah I tried fighting that battle many times. The response this past year has been that it isn't possible. At this point it's a matter of days/weeks and knowing luck, it'd probably get screwed up.

@RobertEG thank you, yeah I almost wish they were more regulated. Hopefully they'll take it off next week.

EX removes them the weekend of the first FULL week in the month. TU&EQ have typically removed 1-3 days after the first of the month with the exception of inquiries which go the very day they turn 2 yrs old.

@gdale6 Thank you, exactly what I was looking for. Sounds like their derog drops almost mirror their inquiry removal processes.

From what I have observed, it is something like two full weeks including two full weekends? My best guess would be around the 19th?

Thank you. That kinda sucks lol. It's come off TU and EQ already and I'd love to lose it ASAP from EX as most of my pulls come from there. Oh well, after this long, what's a couple more weeks?

PS welcome back @Anonymous !

Following this thread, my last derog is on EX and according to the Annual Credit Report shows this April as dropping off. As of today it's still there.

EQ - 841 / TU - 813/ EX - 823

@IntegerIntrovert So is mine. I've been checking daily - what we're seeing seems to bear out what LaHossBoss said above, that we are looking at about a week still. Almost there!
