I have a medical collection account I want to get removed. If I pay the OC the money and then DV the collection agency will it get deleted? I would think if the OC is paid the money the collection agency cant validate the debt then correct? I have tried DV, PFD letters you name it with this agency and I cant get this collection off my report. If this wont work I will have to try the HIPPA process and see where that ends up. By the way the collection agency is credit collections U.S.A.
If the debt is paid, then the debt collector has no problem validating the debt.
"We verify that the amount of the debt is $0." That is accurate. So they can validate.
Unless you live in Texas, the debt collector has no requirement to provide debt validation, only to cease collection activities until such time as verification is presented.
With the debt now paid, collection authority is effectively terminated. So they have no reason to respond to a DV request as a prerequisite to resumption of collection activities.
I would suspect they will probably just deposit it in their circular file.
I believe the OC has to be paid, in order to do the HIPAA progress.
As long as you have the funds to pay, I would try to contact the OC and ask if they still own the debt.
If so, ask if they will accept payment and pull back the debt from the CA.
This is the way I handled most of our medical debts, only a few were sold to a CA.
The ones sold to CA's, I was succesful with PFD letters.
Good Luck to you and let us know how it works out
I have contacted the OC in the past month and they didnt even know if they owned the debt or the collection agency did. I asked the OC to pull the debt back from the agency and they acted like they didnt know what I was talking about. They both sound like a bunch of bumbling people who dont know much about the debt. I will gladly pay the debt but I cant get anywhere with either of them. If I could find out who truly owns the debt I could pay it and get it removed. How do you truly know who owns the debt?
