Collection BS

Ok I have All Collections gone except one from 2004 for 141.00.. The CA says pay it , but they can not remove it.. THEY  say its agains the law for them to do this..  So I called the original creditor and told them I never recieved a bill or any services they are saying I did... Now it gets tricky .. The original creditor says I dont have any thing showing for the amount of 141.00 in fact they have never seen meat the radiology group.. So I called the CA and said that there info was false that I had talked to the original creditor and I dont have any accounts in that amount with them and that they have never seen me.. The CA called me a liar and said if I do not pay this in 30 days they will take me to court.. I told them I will pay it when the agree to remove it , but the supposed original creditor says I dont owe this amount or any amount... Should I have my lawyer file a cease and desist letter to smith and rochoen.. All these dumb idiots have to do is take my 141.00 dollars that I don't even owe and make 3 phone calls to have this removed...   Are CA's just generally stupid ... Where do they hire these 5.00 hr workers... Man you would think if someone was willing to pay a debt that they never recieved a bill for and the orginal creditor even said they didnt owe it ,, they would be happyy....Maybe its Identity theft>>>

I would see if the original creditor will contact the ca. I had to do this early today with one- it was also a false debt. The original creditor contacts the ca to have it removed. The CAs are really stupid and rude- they did a hard pull on my credit and when i disputed, they told me they didn't have to have my permission to do pull a cr. I was also told that I had to pay the debt and couldn't contact the original creditor because they all ready had the debt. Now, that the error is resolved, I am going to call them back tomorrow and see if they will have the inquiry removed from my cr.

Was the account SOLD to the CA???...if so...the OC purges all records from their files...when they sell to a CA...so that's probably why they are saying that...send a DV and see what happens???...I'm guessing are you within SOL???...

If you believe this is not your debt and you the OC says they have no records of it, then I'd dispute and/or file compliants.
 
Does your CR show the OC? If so, you may be able to mail a copy of the letter from the OC to the CRA and dispute as "not mine".
 
If so, I'd get a letter from the OC saying that this is not your debt. I'd mail a copy of the letter CMRRR to the CA and demand a deletion. If they fail to comply, you will file complaints with the BBB, your AG, their AG, and FTC.
 
If they don't delete, then file complaints. I'd start with the BBB, seems they have more luck getting something done, especially if the CA is accredited by the BBB. If they don't respond, they lose their accreditation.
 
I'd then file complaints with the AG offices if no outcome with BBB.
 
You don't have to file complaints/dispute in steps. You can do it all at one time if you want to hit em hard. You can mail them a letter, mail the CRA one, file complaints with BBB, AG, FTC, all in one day if you wish.
