Collection question

I have a collection from Pallisades. DOFD 01/2005.(Equifax). Past SOL in VA( 3 years ).

 

This happened before I knew of this forum

 

Before I knew that Pallisades, was the real CA, I was contacted by an attorney saying that their office is responsible for collection of that account. This attorney had previously obtained a Judgement against me , in favor of Discover Cards. I got scared and communicated with that Attorney's office by fax/mail(not by phone), to settle this amicably. The attorney's office replied to settle for 90% of the amount, which I could not pay. After this I never had any communication with any one, attorney or CA. I never made any payments or promise to make any payments.

 

Question. Will this change DOFD or cause any problems if I DV Pallisades.

The DOFD can not be changed.  It is set by the OC.

 

The only thing that could possibly be reset is the SOL.  Depending on what state you are in, acknowledging the debt or promising to make payments can restart the SOL.  Look up your states laws on SOL.

 

You say the attorney got a judgment against you. Were you sent a summons, did you go to court?  Is this showing on your CR?

 

The only way the DV could cause problems is if the SOL was restarted, then they could sue you. But from what you said, you have already been sued.

But that was a different case. Yes in that case, I was sent summons. I did not go to court, so got the judgment as default, I was ignorant at that time in 2004.
