Collection ?

Under what circumstances can a removed collection return with a different agency ? I had one removed by bbb one disputed verification and one disputed based on a letter they sent saying they got new info and they will contact all 3 agencies to remove

Based on information that is confirmed. I would suggest to settle before they report. Once it hits your credit report it will be harder to remove.
Call them and grt settlement. If can't afford it now then set up monthly payments. Of course if it is valid debt.

If it was re-inserted write letter to CRA; If nothings changed after 60 days, then think abt settling.

 

Dear Equifax:

I previously disputed the above captioned entry from __________ on my Equifax report, and Equifax removed it. This was verified on my credit report dated_______________, Confirmation #________________. I have since learned that Equifax has improperly re-inserted the entry from ________________ on my report. Equifax cannot re-insert derogatory information on a credit report without first notifying me in writing, which it failed to do.

The Fair Credit Reporting Act, 15 U.S.C. 1681(i)(B) (ii), states:

Notice to consumer. If any information that has been deleted from a consumer’s file pursuant to subparagraph (A) is reinserted in the file, the consumer reporting agency shall notify the consumer of the reinsertion in writing not later than 5 business days after the reinsertion of, if authorized by the consumer for that purpose, by any other means available to the agency.

Equifax never notified me in writing of this re-insertion within 5 days, therefore, pursuant to the Fair Credit Reporting Act, this alleged account needs to be deleted from my Equifax report.

Please delete the account _____________ from my Equifax report.

Thank you for keeping my credit report with Equifax up to date and accurate.

Thanks guys i don't think I'm explaining it right basically I had a debt b4 with one collection agency disputed it it was removed then 2 months letter returned with a different collection ... So what I'm askin is how do I know if the 3 I recently had removed will be gone for good ? And what could make them come back thanks again

Only one collection can be actively reporting with balance. If CA decides to sell collection to another CA then one of them should be reporting 0 balance.
I don't see why thry would come back for the same debt

If the account# and the balance with the Oc are reported correctly on your CR, than there can be more than one CA's collecting on behalf of OC. But only one CA is allowed to report and collect on the OC account

 

You may have gotten a DELETE before for the OC/CA by complaining to BBB, however, the OC can hire a new CA and try to collect. The OC is not required to report, nor is the CA but the CA can if the new CA so chooses.

The oc is showing as charge off with amount originally owed but balance 0 on 2 of the accounts

so you have one tradeline from the OC on the report. Does it show on the OC tradeline a Transfer/Sold comment.

 

do you have more than one Tradeline showing/refrencing the very same Account#/OC/Bal but two CA's listing the tradeline.?

 

if only one CA/JDB is reporting it, then the reporting by the CA/JDB is correct. there is no InAccuracy in Reporting. Your OC charged it off/ reported a zero balance and now the CA/JDB is reporting on that collection.

 

If  earlieryou had the CA deleted and that same CA/JDB has re-appeared on your Credit Report then it would be a Re-Insert.

If a different JDB/CA is reporting on it then that is allowed.
