Collections help!

So I am brand new to the forums and can't seem to find exactly what I am looking for.  I had an Old Navy account that got charged off.  I settled with the collection company and thought it was all done with.  To my surprise I decided to check my credit and there is a collection account for the difference between the settled amount and the amount owed.  I contacted the company and they sent me a letter saying that this account was settled in full on 4-25-08.  My question is that I spoke with someone in cust. serv. and they said that they will not list this account as paid from the date back in April but effective of December 2008.  Is this right?  Or is there something I can do to have them show the truth which is it was taken care of 8 months ago.  Any help would be great.  Thanks.

If you did not get it in writing that the settlement paid the account in full, they can try to collect the difference.

 

It does not really matter which date is used, a paid collection is just as bad, score wise, as an unpaid one.

 

Which company did you talk to, Old Navy or the CA?

If it was paid in April, that is what the report should reflect.  They do not have to report but when they do they must report accurate information.

When they do report, which I was informed by the CSR that they will do, if they don't report the april date what is my next step?

I would file complaints with the BBB, FTC, your and their AGs.

If you have it in writing dispute in on all three CR's and send a copy of the letter with the dispute.

I recommend NOT disputing with the CRAs - it is responsibility of the CA to report correctly - you're better off sending a CMRRR letter to the CA stating they have an obligation to report correctly, and the tradeline is not reported accurately. give them 10 days to fix. if they don't fix, then you can send them an ITS letter.
