I sent ARS Account Resolution a timely DV letter. this is the body of the letter.

To Whom It May Concern:
I am sending this letter to you in response an item your company has placed on my credit report. Today 3/28/2013 was the first time I have become aware of this alleged debt. Be advised, this is not a refusal to pay, but a notice sent pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested.
This is NOT a request for "verification" or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your office provide me with competent evidence that I have any legal obligation to pay you.
Please provide me with the following:
If your offices have reported invalidated information to any of the three major Credit Bureau's (Equifax, Experian or TransUnion), said action might constitute fraud under both Federal and State Laws. Due to this fact, if any negative mark is found on any of my credit reports by your company or the company that you represent I will not hesitate in bringing legal action against you for the following:
I would also like to request, in writing, that no telephone contact be made by your offices to my home or to my place of employment. If your offices attempt telephone communication with me, including but not limited to computer generated calls or correspondence sent to any third parties, it will be considered harassment and I will have no choice but to file suit. All future communications with me MUST be done in writing and sent to the address noted in this letter.
This is an attempt to correct your records, any information obtained shall be used for that purpose

I got a one page response that said this.

As you are already aware, ARS represents the doctors who provide services for healthcare facilities throughout the country. In respone to you request for verification of debt we have listed the information below. ARS has confirmed the oustanding balance of 471.00. This past due amount remains outstanding from services provided on the following dates:

10/02/08 $471 $471 xxxxxxxxx
The account(s) are delinquent and may have been reported to the credit bureaus.
Please remit payment in full to the adress shown above.

Sorry for the long post just wanted to give as much information as possible. I have never had any dealings with the original creditor or this collection agency.My State is louisiana this debt IS NOT out of the 10 year SOL. How should I go forward handling this situation?

- Explain and show me how you calculated what you say I owe;

- Show me that you are licensed to collect in my state; and
- Provide me with your license numbers and Registered Agent.

That DV letter is really old and they do not have to respond to every request in it. Since they did verify the debt I would PIF before they get a judgement on you.

There is no law that says they cannot report to your CR before notifying you. Once reported, they should have sent you a dunning notice within 5 days.
They did give you the information that is required of them under FDCPA 809 which is the amount of debt and who is currently collecting. If you had of asked for the name and address of the OC they had to give you that also.
Since they have validated you can offer a PFD.
ARS is really good with PFDs.
I PFDed four separate accounts with them a few weeks ago and they're all deleted from my CRs already.
Hi Jon! I know this is a few months old but this post popped up in Google when I was searching ARS. I'm extremely happy to read see that they're good with PFDs!!
I want to do a PFD with them but I wanted to ask you - did you pay in full or did you get them to settle for less but still delete it? I'm just curious as to what my options are!

This is a 3 month old thread but I will give my advice on it. There's nothing wrong with trying to negotiate a settlement with the PFD. They happen, I've done it with others. Give it a try.
They wouldn't give me a settlement for PFD, but they did give me it if I paid the entire amount so I just did that! They already emailed me the letters saying it was paid in full and that they requested to delete all information off of the three credit bureaus ![]()
