Technically, they can sue you any time as long as you're in the Statute of Limitations(SOL). That being said, entering into a payment agreement will usually keep that from happening as long as the payments are a reasonable amount over a reasonable period of time. What they consider reasonable is up to them.
I also received a pre legal notice from them for my $700 debt. They didn't take action for over a year. I paid them off today for 40% off. I had a previous debt with them for almost $3000 and they never filed suit. Others on here have had them file for $1900. It's hard to say whether they'll file or not.

I'm in the same boat as you. Did you end up taking the payment plan online?

Lol I got sued for $871! They of course won by default because I was young and dumb and I got my wages garnished. Total was well over $2k due to legal fees and such.
