Credit Report Help

I have talked to all 3 CRB and they have all told me the same thing.

I wrote a letter to Midland on March 19th, they received and signed for it on March 21st.

They have not verified that the account they have on my CR is mine to this date. Yet, no any of the 3 CRB will take the item off. They said that they get verification that it is mine and it is up to me to prove it.

What do I do now?

Midland had 5 reports on my CR's and I have had them all taken off except for this one. And I am having major problems with this one.

Another thing how can they report me 90+ days late 22 times after the last date of activity which was October 2004

If you do not believe this is your account and they have continued reporting after receiving DV, but haven't validated, then I"d file a complaint with the BBB.
 
It took the full 30 days for them to respond, but filing a compliant with the BBB worked well for myself.
 
Just state in your complaint what they are in violation of and that it isn't your account.

I would not waste any time with the BBB.
They are not a legal party to any requriements of the FCRA, and have no legal investigation requirements.
I would immediately file a request with each CRA that they investigate the legitimacy of the data reported to them.  They have a legal obligation, upon a consumer inquiry, to investigate in the first instance.  Make them do the investigation.

While it is true that the BBB can not legally do anything, many(including myself) have had great results with the BBB.
 
The CRA only have to verify that the information they are reporting is the same information the creditor is supplying.
 
It is not up to the CRA to enforce FCRA/FDCPA upon the CA.
 
Unless the consumer provides the CRA with solid documents proving this is not their debt, such as a ID theft affidavit, as long as the creditor verifies the information they have provided, the account will remain.

Midland verified with BBB. They sent BBB a 2 page list of credit file. Out of the whole 2 pages there are 3 charges, 2 payments and the rest their monthly charges, overdraft charges, etc. They say it is for an Aspire Visa and they purchased it from Jefferson Capitol

My question they sent nothing that I signed for. They said that they did not answer my DV letters because I did not respond with in 30 days of there request which was in 2006 I never received anything from Midland.

Midland has this as an open credit on my CR

- Balance: $1476
- Type:
- Pay Status: Late 120 Days


Where do I go from here. On my hard copy of CR it states the Date of status is 10/2004. If this was an Aspire Visa and they purchased from another collection agency how can it be an open account. Then they mentioned to BBB that they amount is higher then the original amount because they can add interest.

I also wanted to mention that TU just this week deleted this account from my CR. If TU deleted doesn't that me that they could not verify?

Did TU delete because of a dispute?
 
If so, it doesn't mean that the CA couldn't verify, it could be because they didn't respond or any other reason.

Need to check your state statutes to see what CA are legally able to add and what they can not.
 
What state are you in?
 
Is this listed in the "collections" section of your reports or the TL sections.
