I have been requesting GC services to validate a $1200 cell phone debt for 3 to 4 months. I have called, sent letter and just this last time, sent a certified letter. I was reading on other sites where I only have the 1st 30 days to validate the debt. Is that true?
When a dunning notice is sent, or first contact is made. You have a 30 day window where the DV would be timely. Meaning that they must cease and desist all collection activity until such time as they verify the debt.
Your first letter may have invoked this, meaning they will not contact you or try to collect the debt until they verify.
If I missed that window do they still have to verify that debt?
If the DV was not considered timely, they do not have to respond and don't have to cease collection activity.
