So I had a judgement against me because of a Midland account. It was put against me in July and I was never served. I have settled it and now want to get it off my credit. Is my best bet to try to vacate or set aside and what is the difference? Thanks everyone!
Usually means the same thing.
But is setting aside a goodwill gesture? Can I have this done even if I cant prove that they didnt serve me? How do you even prove that they didnt serve you?
They mean the same thing. If it is approved, its like the judgement never existed....in VA, you can set aside a default judgement if upon satisfaction. I don't think they vacate judgements here....
Contact the court house and get all the paperwork on the judgment. There should be something in there about service.
Because you paid it I am not sure you can have it vacated. That would be something to be done before it was paid.
You can see if your state allows paid judgments to be vacated. Vacating would also be a goodwill gesture. It is up to the judge.
Thanks guys. One other thing. There is only one CRA reporting the judgement, does that mean that the other ones wont in the future? thanks
Hard to say. Judgments aren't reported in the normal way everything else is. 3rd parties are hired to collect public records.
