I'm not sure what my next move here is.
I disputed paid student loan collection accounts that were never removed after rehabilitation. They were listing as opened and in default still; but mostly I was trying to get them removed as per my agreement with the default loan resolution group. There are a total of 9 loans; 4 of which have been paid off for 4 years.
They were updated to paid, closed, but all of them were updated to in collections as of Feb 2016. This isn't true for ANY of them, but is especially innacurate for 4 of them.
Do I have to file another dispute to remove the new inaccurate information? Method of Verification letter? This is *very* annoying considering that all of them are paid off.
I sent a goodwill letter to a bunch of the executives at the department of education in the region that handles my account, but who knows what I will hear back on that.
Legally, what are my options here?
Did your dispute clearly assert that their continued showing was being disputed based on completion of rehab, or did your prior dispute simply contest the accuracy?
Removal based on rehab is separate from removal based on accuracy of the derogs.
Adding or correcting the actual derogs would be proper if rehab had not occured, but would not be proper if the issue is removal based on rehab being completed.
If the prior dispute was clearly based on completion of rehab, I would file a complaint with the CFPB.
However, if the issue of rehab was not clearly stated, a renewed dispute that raises that basis would first be appropriate.
I had ti dispute student loans that were showing as in collections, but were actually paid off/discharged by disability two years ago... THREE times before it came off. And then some of them removed all prior late payments, which I appreciate, but isn't even accurate. Oh well. But yeah it was insanely frustrating trying to get that collection status off. It should NOT be this hard to accurately report my accounts, and I would love to know how loans that were discharged can be VERIFIED as in collection.

In my dispute I mentioned both that the status was incorrect, that the outstanding amount owed was incorrect and that they were supposed to be removed because of rehab according to the Department of Education Default Resolution Group, and that the "payment" data of charge off spanning the past 6 months was incorrect. Some of these were inserted only a few months ago, and upon further investigation, fact checking with NSLDS 4 of them don't actually exist. They are all listed under the same account number, I only realized it looking for the original loans and realizing they added up to a lot more than I ever borrowed.
I'm confused how they can verify accounts that don't exist at all and update payment data that I can clearly see via NSLDS is incorrect. They have all the dates listed I paid, when I defaulted, and when the accounts were paid in full by me or consolidated. It's incredibly detailed and doesn't match up at all.
As for the removal itself, I emailed the Department of Education executives and they passed on my letter to an executive that could help. I wish I had realized when I wrote my letter that some of the accounts inserted weren't even real, because that probably would have helped my original case and I'll have to wait to hear back from someone who can handle my account.
I guess I probably should have asked which information to dispute in the first place, but I figured pointing out all of the errors with the obvious issue that they were rehabbed and still show up as collection accounts open with balances with clear proof that they are paid off would cover all of my bases.
