Hey everyone, sorry for my ignorance.
So I am trying to rebuild my credit, and I have a ERC debt from sprint, I did start an account with them but I canceled. So I disputed this debt twice now with credit karma. It is still showing? And now there is a comment saying "Account information disputed by consumer, meets FCRA requirements"????
I though they lost power to report? Others say within 24 hours their debt is removed but mine has not been. Am I possibly doing somthing wrong, if so what do I do different? Maybe get them to validate the debt in writing? Or dispute the debt in writing to the credit reporting agencies?
Please help, this is one debt I don't owe and really need some help fighting these monsters.
Did you ever receive a formal Notice of Results of Reinvestigation regarding the prior dispute?
That is the document which formally concludes any dispute, and provides the results.
The issue is apparently whether your prior "dispute" was actually received by the CRA and processed.
I know that Credit Karma has something that they call a direct dispute that you can file with them, and they will then submit to the CRAs. That is a misnomer, as the FCRA has a specific direct dispute process that is detailed under FCRA 623(a)(8), and does not involve the CRA in any manner. A direct dispute is filed by the consumer directly with the furnisher, not with the CRA.
If you have never heard from the CRA, then you have no official resolution of any dispute that was reinvestigated by the CRA.
As an aside, while there appears to be some posts floating around the net asserting that ERC is barred from reporting to the CRAs, there is no current evidence to that effect. It is apparently a rumor with no supporting evidence.
If ERC ever had legitmate collection authority by assignment from Sprint, then they can report their collection.
Your cancellation of any payment negotiations would not be relevant to requiring removal of their reported collection.
If you have real evidence either that they do not have the ability to report to a CRA, or that they never had legitmate collection authority, you can certainly submit that evidence to the CRAs to support their lack of a valid collection. However, a mere rumor that they dont have reporting ability wont cut it.
Always dispute in writing and mail with CMRRR! Try it in writing, mail to all 3 bureaus, CMRRR, and see what happens. If it comes back verified, I would contact sprint and see what happened. I haven't personally dealt with Sprint, but they may be able to recall the debt if you agree to pay (or have documentation regarding the cancellation). Once it is recalled, you it should be removed from the CRAs. It's worth a shot!
OP....did you cancel the agreement between you and the CA, or with Sprint?
