Finally going to do something but need some guidance.

Hello all

 

I pulled my credit with Equifax and with a FICO of 608 I need some help getting it higher.  I know there are a total of 3 report agencies but I figured I need to start somewhere.  In a nut shell I currently have two accounts listed on my credit report: one account with a balance, Zero accounts opened with in the year, two recent inquiries, and one in collections.  I have done nothing at all for these accts and would like some guidance on how to proceed to clean up my credit.  Do I start with a DV and then move to MOV or PFD?  Once I know how to proceed I can generate the letters and go from there.  I just need some info on where to start. 

 

Sorry not sure how detailed I should be with my personal info.

Ok after reading more about DVs I don't think I can do one.  According to many different posts on this site a DV is only valid with in 30 days of notice.  I pulled my CR back on 8/2008 which will take my past the 30 days, I guess I can always say that I really never looked at it till now...but not sure how that'll work. 

 

Will I be better off just sending a PFD?

What is the collection and who is reporting the OC  a CA  or both. What is the DOFD/DOLA?

 

What is your SOL?

Thanks for help on this...here is the information I can get off of EQ.  I live in CA so the SOL is 4yrs:

 

The acct that has a balance is being collected by a CA "Palisades".  Not sure who the OC is.

Due: $373

Status is 120+Days past due

Status as of [?] Jul, 2008

Date opened [?] Not Reported

Date of last activity [?] Nov, 2002

 

The acct in collections is from a CA, they do not provide a name but an ID #  of some sort: 701yc00488.  The OC for this is WAMU

Due: $525

Date assigned [?] Jan 01, 2008

Date reported [?] Feb 01, 2008

Date last active [?]Nov 01, 2006

OP, pull your CRs directly from the CRA. 3rd party sites like myFICO will often mask the CA and OC name.

I'm due to get my free yearly report from annualcreditreport.com end of this month.  I am anxious to get started so I should just pay and get all three CR from the CRAs?  Any advice on how to do that online...meaning do is there a site a can pay for all three or do I need to pay seperately for them?

You'd have to pay for them separately. Now, I get my EX and TU reports for free. If you subscribe to TrueCredit, you can get TU for free. I subscribe to creditchecktotal and get my EX for free. If you have been denied credit in the past 60 days, then you can get the report that was pulled for free too.

 

If you do buy online, skip the scores. I think each report is $10.

Just pull 1 of the free annual reports to get the info you need. you can get the others later to check progress.

Hi genetiv.

A DV letter is only sent to a CA in response to a formal collection notice sent to you.  It is not an admission of anything, but rather a request that they validate your owiing of the debt. So, in addressing the CA, did you receive a CA formal notice of collectioin from them?

You never, ever send any PFD letters to anyone until you have accepted the debt, and are willing to pay.  You DV first with any CA, with no discusion of obligation for the debt.

Any PFD letter is, almost always, construed by a CA as an admission of owing the debt, and is not something you want to do until you have exhausted your DV options under the FDCPA, and/or disputed the debt itself with the CRA or OC.  Any admission of debt will most probably, under your state SOL laws, reset the SOL and extend you legal peril of suit for recovery of the debt.

So, in addressing the CA, did you receive a CA formal notice of collectioin from them?



I have receieved mail from collection agencies but never opened them, been receiving them for so long I can just tell what the letter is by looking at the envelope Smiley Happy  I do get the calls to but I'm always..."ohhh he's not in can I take a message". 
I'm sure they have records of sending the letters to me so do you think I can still do a DV.  I have the funds to pay them off but I want it off my CR.
