Getting a CA to delete due to licensing/bonding per state requirements

I did a database search on all the CA reporting on my CR. Stated on the website:

Section 392.101 of the Texas Finance Code prohibits a third-party debt collector or credit bureau from engaging in debt collection in Texas unless the third-party debt collector or credit bureau has obtained a surety bond and filed a copy of the bond with the Office of the Secretary of State.

Principal Name: Federal Pacific Credit Company LLC # 1
Address: 1291 South Pioneer Road
Salt Lake City, UT 84104-
File Number: 20030056
Status: Canceled Close File
Date Filed: 3/20/2003
Cancellation Date: 4/30/2004
Phone:
Bonding Company: Old Republic Surety Company
Bond No: 6111

Due to status found, it appears that they are in violation by reporting collections on my CR. What is the best way to persuade them to delete?

Re: Getting a CA to delete due to licensing/bonding per state requirements

If your state requires such and they are not in compliance, I would send them a letter stating that they have X days to delete and cease collections or you will be filing a complaint with the BBB and your AG.

Or you can just file the complaints and skip sending the letter.

Make certain your state requires it tho. Not all states do.

Thanks, I think I'll just go ahead and file the complaints.

Re: Getting a CA to delete due to licensing/bonding per state requirements

I just read a post yesterday.  Apparently a CA does have to be bonded/licensed in TX.

I would like to suggest that you send the CA a cover letter, outlining that you have filed a complaint with the AG and BBB.  I would also suggest that you send a copy of your complaints with that cover letter and further, that you send the letter and enclosures CMRRR to the CA.   That's what I would do.  It would probably give the CA incentive to delete a lot quicker.  I would still file the complaints to prevent them from doing business without the proper bonding/licensing.

Re: Getting a CA to delete due to licensing/bonding per state requirements

First send the CA a letter stating that they are not licensed to do collections in the state of Tx. They are in violation of Tx law.........delete this account from all CRAs that they are reporting to within 5 days!         CMRRR

When they sign for it.....dispute with the CRAs (not mine)     saying that they are violating your state law by reporting.........Delete this reporting.

File a complaint with your AG office....the state that the CA is in AGs office..... and.the FTC

Re: Getting a CA to delete due to licensing/bonding per state requirements

In TX. only bonded. I don't think they have to be Lic.

Happydays: that sounds like a great idea! The only problem is I filed complaints with the BBB and My states AG already. I might send the letter anyway telling them they are in violation. Also send what proof I have to the CRA. I just feel that they are not quick to listen to the consumer. That's if you can even get past the language barrier.

Here you go http://direct.sos.state.tx.us/debtcollectors/DCSearch.asp

To my disliking, the other CA are legit at this angle. Getting 2 deleted because of this is not bad though. I think you just have to keep looking for their dishonest ways.

Re: Getting a CA to delete due to licensing/bonding per state requirements

Maine is the same way a CA must be licensed. Here is a link to the state's website.

I have found several CA on my wife's CRs who are not licensed in Maine and as the consumer protection agency has informed me if they are not licensed they can not collect from Maine citizens.

Re: Getting a CA to delete due to licensing/bonding per state requirements

All I did was typed the name of the CA in the "principal name" field. just get as close as you can and put a % symbol at the end of the name. The first couple of times I got nothing as well. I think the database may be a little glitched out. Sometimes nothing would come up, and I would simply click the search button again and it would pull up the info.
