Getting nowhere with the CRA's; in need of some guidance

I've been disputing student loan late payments for the last four months.

 

 

I called TU to discuss why my dispute is not being taken seriously. The first person was unhelpful and just kept repeating the same thing that, "They don't verify information." Instead, they send my dispute and corresponding material to the creditor. If the creditor confirms that they own the account. Then the collection (or whatever) stays on my report.

 

I asked how that makes sense that, as a consumer who sent actual bank statements indicating that the collection agency is outright lying, that they simply require the furnisher of information to say, "Yep, I'm right; the consumer is wrong." He repeated that "the creditor confirmed they owned the account," and he said TU doesn't review my bank account information even if I send it; they simply pass it on the creditor.

 

I escalated to a supervisor and the supervisor said the same thing, that TU doesn't verify the accuracy of the account, just that the creditor who says they own the account actually owns it....? Really?

 

That still didn't make since, so after another 20 minutes of trying to figure out how to actually dispute this fraudulent claim, I escalated yet again to the "special handling" or something, department. He too said that they don't verify my information, they simply confirm with the creditor that they own the account they say they do.

 

I'm really at a loss here. What do the CRA's actually do then if they don't verify that what information is correct? I mean, can I just start throwing claims out there that this random person owes me money and unless the person can prove that they don't, then they actually owe me money and I can ruin their credit?

 

This seems just crazy that after 4 months and dozens of hours on the phone, writing letters, sending documents, collecting bank account information, driving to the post office, etc, that my claim is not being taken seriously.

 

I submitted a claim to the CFPB and the original creditor simply confirmed that they owned the account and that they don't need to update the CRA's because their information is already complete and accurate.

 

No, I asked for proof that it was complete and accurate. Just because they say it is doesn't mean crap...actually, appears that is all it takes to ruin someone's credit. Just say you are right, and if you are a creditor, then screw the consumer.

 

Is my only option to pursue them via civil lawsuit? Because this is asinine that it is this difficult to get clearly inaccurate information off of my credit report.

FCRA 611 places the final verification of accuracy upon the CRA.

The CRA refers the dispute to the furnisher, and the furnisher is required to conduct a reasonable investigation and report their finding to the CRA.

Their finding is part of the total information used by the CRA in its reinvestigation, but the CRA is not required to simply conform with the finding of the furnisher.

A CRA statement that they simply comply with whatever is recommended by the furnisher is clearly a misapplication of their statutory obligation to reinvestigate.

 

You can file a complaint with the CFPB, but unless they choose to litigate for you, cannot compel the CRA to reach a different finding.

 

To get all of the facts considered and obtain a binding determination of verification of accuracy will require civil action, and a determination by the court.
