Help-Ca to drop off calling

Ok...I have a CA that is supposed to drop off on some reports showing Nov. and some Dec.  They are collecting for Capital One.  It is an account that I haven't used since December 2001 or so.  I will have to go back and look at the old statements.  I was cleaning my report and now they are showing that I was 120 days late in July 08.  I have not received anything or heard from them in years.  The SOL has passed.  What should I do?

Can they resell the debt to another ca? And does the DOFD remain the same from the original creditor?

They can sell the debt or assign it to whomever they want. The DOFD does not change. It's in the law, it's in FTC opinion letters and any change to the DOFD is illegal.

Once an account reaches collection/charge off status, the DOFD never changes.

 

Keep proof your DOFD. Keep those statements, keep your CR showing the removal date.

 

If passed SOL, do not do anything unless you PIF one lump sum.

 

Yes, they can continue to assign/transfer/sell the account from now to the end of time. They can try to collect on it forever as well.

 

What they can't do, legally, is put it back on your reports once CRTP has expired.

 

They can file suit at anytime hoping you don't appear and they get default judgment, so always pay attention to letters, especially court letters. Expired SOL is only your defense if you use it.

 

If another CA contacts you, you can always send a C&D letter.
