Help Understanding Dispute Process

Hi :-) I am hoping that I can get some clarification because I am trying to figure out what to do next.

 

I started the credit journey in September 2012 in the LOW 600's and didn't realize exactly what I was dealing with at the time. I started slowly to make sure that what I was doing would work. The more patience that I had the more baddies (I started with 9) fell off. Fast forward to September 2013, depending on which CBR you look at I have zero, one, or two. I disputed the two items on EQ and they removed the items - it's clean Smiley Very Happy. I then turned around and disputed the same two baddies with EX and Tu. This is where it gets tricky. TU removed 1 of the baddies, but "validated" the other. Then EX "validates" both of the items.

 

How is that possible?Smiley Frustrated So I go back in to dispute the items again with each of the corresponding CBR's. Well now EX is saying cause I already disputed the item and they "validated" the debt that I can't dispute it online, that I have to write to them. Even though the baddies was removed from the other CBR's should they remove it from ALL of them?

 

One of them will fall off in 2014 and the other 2015. It hasn't stopped me from being able to get a new vehicle, but I want to refi to get a lower rate within the year. I have done so good and feel kinda sad that these two items are a road block in some way.

 

I figured that someone on here would know what I am talking about in the long rambling. Smiley Wink

Each CRA works independently of one another.  If one deletes, the others do not have to if they verify the debt.

 

All the creditor has to do is say yes, the debt is valid and it is verified.

 

Are these your debts?  Are they reporting acurrately?  If they are you should not dispute them.

 

Once you dispute a debt and it is verified, then dispute it for the same reason again, the CRA can say it is frivilous and not investigate as it has already been done.

When you dispute with a CRA, they must forward a copy of the dipute to the furnisher, who must investigate and respond back to the CRA.

 

If the furnisher determines that the information is accurate as reported, they can simply verify with that CRA.  However, if the furnisher determines that the information is inaccurate, and they either delete or correct with the CRA handling the dispute, they are required under FCRA 623(b) to report that result to all other CRAs to which they have reported the information.

 

Just as they can choose not to report to a CRA, they can choose not to verify with one, but verify with another.  The requirement to make the same reporting to all CRAs only applies if they have made the postive determination back to the CRA handling the dispute that the information either needs updating or deletion based on the inaccuracy.  Lack of verification, and thus deltetion based on its lack, is not the same as their postive reporting that they have found the information to be inaccurate.

 

The CRA can refuse to conduct a second reinvestigtion of  a dispute that they have already reinvestigated if it pertains to substantially the same information on the same basis.  There are no appeals of a verification of accuracy.  Next option would be legal action.
