Help for Judgment there's no record of.

My hubby and I have been fighting with TU for several years over a judgment that is on both of our CR's.  They keep verifying it.  We sold the home we lived in, at the time, in 9/2004 and were 3,000 miles away when this judgment was supposedly filed (10/2004).  I keep disputing it with them.  The court it was supposedly filed with has no record of this judgment, and will not verify any judgments when a CRA tries to verify(it states this right on their website).  We are in the process of purchasing another home and have to clear this up.  The  tri-merge the mortgage co. pulled shows this judgment, but with no info. on who the court, or OC was, but it does show up on mine as the state we used to live in, with the court listed, but not the OC.  Fighting with TU has gotten us nowhere, and I can't contact the OC because no one has a clue who it was, not to mention how were we sued being on the opposite coast at the time??  This is a fraudulent judgment on our reports.  I am at my wits end and I need help to figure out what to do next, I have a very limited time to clear this up.  Thanks for any help you can offer.

Hi and welcome to the forums.

 

For verification, the CRA does not necessarily talk to the court house.  They can use a database and if the judgment is still there, it will continue to be verified.

 

Not saying it is yours, I am just telling you how they can verify.

 

Stop disputing with the CRAs.  It can lead to worse things happening.

 

I would file complaints with the BBB, FTC and your states AG office.  Be very detailed.

ok.  so where do these databases come from?  What they have in their database is erroneous.  The original court this was supposedly filed in, has no record of this case #, or anything listed by our names, going back 15 years.  I always assumed they contacted the court itself. 

 

I will try the BBB, FTC, and AG.  I appreciate it.   I would never have  thought of contacting them about this.  Thanks so much.

Creditors pay a fee to be able to use it. It is called E-Oscar.  I am not sure how it is updated or who is responsible for updating it.  I know it is web based and creditors and CRAs use it for verification purposes.

 

If anything is left in the database that should have been removed, it will continue to be updated.

 

I would start with the complaints, and see if the court could give you a letter saying they have nothing in there system going back 15 years.  You could send that to the CRAs and see if they would delete.
