I'm a little bit confused about this HIPPA process but really need to use it to get rid of some medical collections. The following are showing up on my report.
Medical Collection from Hospital
$88 paid last report was 4/2011
IC Systems doctor's office bill after lost insurance
$436 not paid first report 3/2005 last report 2/2009
Cable bill in collections
$329 first reported 2006 last report 9/2009 (not paid)
I just recently disputed 4 different address that they had listed for me (online dispute)
Wondering how to begin the HIPPA process to get rid of these items. None of these have been disputed previously. I'm in TN so I also wonder about using the SOL to get rid of.
Unfortunately, a couple of years ago someone claimed ownership to the HIPAA process and asked us to stop posting letters on these forums. As a result, you won't find very many posts on here. I suggest googling "HIPAA process" for more info on the letters to send, steps to take, etc. The only steps I know of for sure is that the HIPAA process, using the Health Insurance Portability and Accountability Act (HIPAA), you leave the CA out of this entirely to ensure the privacy aspect of HIPAA and you'd start by paying off the OC directly. Then there are follow up letters to send, but google for more info as mentioned.
While the HIPAA process has worked for many, and the success for some (not all) is undeniable, in my opinion, the HIPAA process is legally and factually incorrect. I read HIPAA backwards and forwards a few times to get the process to align with the law and I couldn't. I think the CRAs were scared into deleting, but as of lately, I have seen posters say here and elsewhere, that their success has been limited because a CRA or two won't play fair. Seems like EX is the bigger offender. I personally had medical debts report in the past and successfully got them off via a DV-PFD combo, but that's certainly not foolproof either.
SOL (the time frame a creditor has to sue you for an unpaid debt) doesn't matter at all under the HIPAA process because the first step is to pay the debt.
I just yesterday sent certified letters to the OC's saying that they were breaking mine and family's confidentiality by giving name, date of service, place of service, to the collection agency in the first place. (I hope it's okay to talk about this, if not, sorry and I won't again)....anyway, the collections are all paid. So I'm hoping that the OC's will just feel a tiny bit worried enough to ask CA to delete them from reports. I did read that there are new HIPPA laws effective 2009 that play into this, and all my collections are older than that.
