Help with next steps?

I have been battling with two CAs. A little background, one was an apartment complex that sent me a bill I wasn't expecting. I asked for an itemized bill and never got one. A CA sent me a letter to collect and I sent a vaildation letter within 30 days CM RR. I sent a followup letter 30 days after that CM RR. I received no response to either.

 

Second CA was a cellphone company. I cancelled because of a change in their ToS and the CSR said I wouldn't receive an early termination fee. I was sent a bill from a CA for the ETF. I sent a letter requesting vaildation CM RR within 30 days and never received a response.

 

I pulled my CR several months later to find that all three CRAs were showing the collection and it did not show disputed. I copied all my letters, RR, and other info and sent a dispute with to all three CRAs. So far two have come back verified. THEY DIDN'T EVEN READ WHAT I SENT THEM. UGH. I know I can send them a letter requestion methods of vaildation under the FCRA section 611 (a) (7). At this point I am at a loss on how to fight this. Do I need to challenge the CRAs in court? Sue the CAs? Sorry for the long post. Any info is greatly appreciated.

I would file complaints with the BBB, your AG, and their AG.

I assume these letters are directed at the CAs? Would it be adviseable to send them a letter stating they are breaking the law and continuing to do so and I intend to report them the BBB and AG if they do not remove the information?

No, I would just file the complaints stating that you requested validation as allowed per FDCPA 809. They failed to provide you with any validation of the alleged debt, but reported the debt on your credit report, which is a violation of FDCPA. FTC has issued the opinion that reporting on one's credit report is indeed collection activity, which is prohibited by FDCPA 809 when they have not responded to a debt validation request.  You have the return receipts from the post office where XXXXXX signed for the validation requests on XX/XX/XXXX and these debts were reported on your report on XX/XX/XXXX.

 

 

They don't have to validate within any set time limit, but they do have to cease collection activities until they do validate properly.
