Here I am....rebuilding again.

Yep. It's been some 5 years since I filed ch13. I burned alot of the big ones in it. It's my fault 100%.

 

February 2022 will be 5 years since I filed and the case should be discharged (confirmed by my attorney). 

 

My scores are close to 700 now (myfico scores).

 

My one question for the forum -

 

1. Can a creditor report lates (30, 60, 90, 120) after you've filed ch13? I was looking through my reports this morning and I saw that some are doing this and it's probably hurting my scores.

@madmann26  First, you need to make sure that the debt in question is included in your Bankruptcy.  It can be a little overwhelming when you have to list all your debt and due to human error we may forget to list all our debt.  If the debt in question IS included in your Bankruptcy The Debt collector (collection agency) should not be reporting late payments.   

 

Since you have any attorney, tell him/her about the situation and they can contact the debt collector to stop reporting.

It was 100% included. I'm certain of that.

 

The creditors in question reported lates for 5-6 months after filing ch13 but then stopped.

 

And to add, the attorney pulled all 3 CRAs and we went down each line item, one by one.

im in my 5th year post bk13 file date.  mine was for 3yrs and discharged dec.2020.

 

i burned all the big ones. citi, chase, amex, barclays, discover,  etc... 

 

the closer i got to my discharge date i started looking over my CR constantly.  i noticed that amex, chase & discover were reporting lates & incorrect balances for several months after my file date.  i contacted my lawyer and was informed to dispute the lates on everything past my file date.  i did that and they were corrected.   i was informed they cant report lates or collections on anything included in bankruptcy past the file date.   it was my understanding that reports can be updated with accurate information even after bk is filed as long as the information does not surpass the filing date.    in my case chase was updating my old accounts 2 years after i filed to make it appear as if i had just filed bk.  my scores dropped like a rock.  chase was forced to correct their errors but it took complaints to the CFPB to get it done. 

 

however once i got that cleared up my scores didnt come back right away. im told it was due to a status update.  kinda just stirs up old crap. my scores rebounded after 3 months.   im still fighting with discover over the "remove by date" because they are adding 3 years to the DOFD fall off date. which is supposed to be in may 2024.  so you might wanna make sure your fall off dates are correct too.  

 

im 13 months into my rebuild.  its been successful so far but it sure has been tough.   good luck to you!

I'm starting to look more closely at my reports this week. I have so far found 2 car loan accounts and 2 credit card accounts with reporting lates/CO post CH13 filing in 2017 and even some well into 2018.

I know the 120-150 day lates are still dinging my scores but geez, reporting lates post filing? That's crappy as they come.
