Re: Why is this OK? How are they allowed to do this?

I would probably dispute it all. It looks like triple reporting to me.

Re: Why is this OK? How are they allowed to do this?

It seems that way to me also. That's why I wanted to discuss it on here first.
I'm definitely going to call them, but I need advice first. I don't want to say or do something that's going to result in an adverse action and make it worse.

Re: Why is this OK? How are they allowed to do this?

You can call and ask, but I advise you that it is not triple reporting. Just a quick search and reading other threads will show you this, as the original creditor they are allowed to keep their original account on your report even after sold. The only stipulation is that they update it to a $0 balance and show that it was sold/no longer past due as they don't own it. You can call and do a direct dispute with the creditor themselves, or dispute via the CRA as incorrect reporting. Hopefully other long time members will chime in with the same advice I have given. I had the same issues when I started on here years ago and cleaning my reports. I had the same accounts just different balances. Government student loans.
Don’t take your credit for granted, use it with care! These days, catch me in the bankruptcy forum!?

Re: Why is this OK? How are they allowed to do this?

Cartwrna.....

Thank you and I do appreciate the advice so far given. When all three company are listed under US Dpt of Education, it's raher difficult to NOT to see all three companies as one in the same. All three companies say US Dpt of Education, and when I called one of them long ago, they told me they did not have my loan. So my thinking was: "US Dept of Education no longer has my loan. I know exactly where the rest (and bulk) of my loans are. With one company, all reporting as deferred.

Im only having this issue with these two specific loans. I didnt post in the student loan forum because theres not really traffic in that forum.

Also,

To the Moderators of MyFICO, is there already a permanant "sticky" (whatever its called) that lays out the reporting of student loans and explains and gives a break down of how they many show on a credit report? For educational purposes? You guys may have already done this?

Re: Why is this OK? How are they allowed to do this?

Its starting to come back to me a little bit now that Im talking about it. US Dpt of Ed was calling me about the loans starting to become past due. They sent me this stack of papers to fill out (like a financial profile or something) and I sent in everything (check stubs, proof of other living expenses etc...) It was then that they were put in deferrment. A couple of months later, I start getting calls AGAIN about them going past due. I told the rep on the phone that I had already been through the process and they were put in deferrment as a result. This dude knew NOTHING of what I was talking about.

Deferment only lasts for a certain amount of time then you have to reapply. Plus if they back date you will have to file for a new deferment faster. Ie..unemployment is only 6 months at a time.

Re: How are they allowed to do this? *UPDATE*

So after a little back and forth with both ACS and Nelnet, (still currently being researched by both)

It turns out that that these two loans were "Direct Loans"

AFSA  ----> bought out by ACS ----> who was also Direct Loans servicer----> which explains why I was under the understanding that my loans were in deferment the entire time. ACS supervisor said "AFSA " should not be showing at all.

How in the world did this stuff get so jacked up? Smiley Indifferent

Re: How are they allowed to do this? (1st UPDATE)

Nelnet Response:

" Thank you for your recent credit reporting inquiry. After careful review of your account we have determined that the student loan(s) referenced in your request requires no adjustment because:

Your loan(s) defaulted. The default will remain on your credit report for seven years from the date of default.

Under the Fair Credit Reporting Act (FCRA), data providers are not required to investigate certain disputes received directly from consumers. For you future reference, examples of those instances include:

!) A request that is submitted or prepared by a credit-repair organization on behalf of the consumer, including submission of a credit dispute on a form supplied to consumer by a credit repair organization

2) The consumer has not provided sufficient information to investigate

3) A credit dispute that is substantially the same as a dispute previously submitted by the consumer and investigated by us

Just know that we are here for you when you need us. If you have any questions ......blah....blah....blah......blah....."
