How do I find the DoFD?

I got a letter from midland about an account from citi I had years back. Neither the OC or CA are showing on my credit report. I want to know if this debt is still within the SOL. Also, any advice on the next steps to take would be appreciated.

You can call Citi and ask them what the DoFD is.  Hopefully they still have you in the system.

 

Send Midland a DV letter.

 

SOL for your state?  What state are you in and when you say years back, how long ago was that?

I'm currently in Wisconsin but opened the account and went delinquent on it in Illinois. I opened the account in 2005 and maybe went delinquent in '07 or '08. I'm not disputing the debt is mine. Is there any reason to send a DV?

A DV, if timely, would put in place a cease collections bar.  Which means, they haven't reported yet and once they received the DV they couldn't until they validated the debt.

 

If you went delinquent in 07 or 08 there would be 2 - 3 years left for them to report.

 

SOL in WI is 6 years.

DOFD is determined based on the history of the OC account, and is thus a factual determination.

Your account records are thus the basis for "finding" the date you first went delinquent and never brought the account back into good-standing before it was referred for collection.  If you dont have adequate records, you can always request the OC to provide them.  However, they are normally not compelled to provide prior account records if they sent prior billing notices establishing a billing due date, upon which DOFD can be determined.

 

Neither the OC nor the debt collector are required to provide the DOFD until they have reported to a CRA.

It is not a credit reporting issue until they have done so.  The credit reporting relevancy of DOFD is to estabish the date for calculation of the ultimate date of exclusion of a reported collection or charge-off.

 

You want DOFD for a different purpose.... under the assumption that DOFD will most likely also define the date of commencement of the statute of limitations on the debt.

Developing an SOL defense is not something a creditor will most likely go out of their way to assist the consumer in establishing.  Thus, in contacting them, I would not mention SOL.

Do you have ANY account records to support the date you first went delinquent, and thus established the date upon which they could have first brought legal action?

No, unfortunately I don't have any records.  I was an idiot college kid.

 

I guess I could just write a letter to Midlan and try to get them to settle and then GW the hell out of them.  I'm not denying the debt is mine and I realize that I'm responsible for it.

So since this account from Citi is not showing up on any of my credit reports what should I say to them when I call them to find out the DoFD?  Is there a chance that they won't tell me?  If not, then what do I do?
