yes, it is from 2013. i've sent a DV twice, and received nothing, i also filed a complaint as well with the cfpb on 12/9 as well. im still waiting for a response, as of 12/21, all i received was "
SECURITY CREDIT SERVICES, LLC has responded that it is still working on your issue." and stating they have 60 days to respond. i've been requesting information since September, and have received nothing. i will send a follow up to the CRA's. all this company does is update every month. |
Finding a collection entry on your credit report does not trigger your validation rights under the FDCPA. The JDB was not required to respond.
The FDCPA sets no period for response, or even any requirment to respond, to a DV request.
FDCPA 809(b) imposes a cease collection activity bar on a debt collector if the consumer sends a timely DV request, and the debt collector can choose not to respond. Violation only occurs if the DV was sent within 30 days of the dunning notice and the debt collector thereafter resumes active attempts to collect on the debt, such as calls or letters, without having first provided the requested validation.
They have also not initiated communication with the consumer, and thus have not yet triggered the requirement of FDCPA 809(a) to send a dunning notice. Thus, there is/was no right of a consumer to send a timely DV request that imposes any collection bar.
There is no violation of the DV process under the FDCPA.
