How to communicate with CAs?

To make a long story short, I have defaulted student loans currently in collections. I am paying on some, but not all of them right now. As a result, I receive regular calls from CAs regarding the loans that are not currently being paid on. The reality is, I have every intention of paying these loans and doing it soon, but I just have to prioritize right now and I would like to get my credit card debt paid off before I start throwing money at the defaulted student loans. That see,s like the best way to improve my situation for the long term.

 

I saw a post saying that you should always answer CA calls and not ignore them, but them somone replied that the overwhelming opinion is that you should not talk to CAs over the phone. Soooo....

 

How should I handle communication with the CAs? Should I send them reply letters explaining that I cannot pay now, but fully intend to pay in the near future? Is there any trick and/or advice for this type of communication? So far, I have generally been ignoring them, but I don't want them to sue or cause additional probelms for myself. Since there is no disputing the fact that these are my debts, I am not really worried about "admitting" to the debts. I just want them to know that I'm not a lost cause and if they're just coorperative and patient, they will get their money Smiley Happy

You can stop the phone calls but you have to make the request in writing to the CA's requesting that any further communication be done only via letters. You can also request that the CA's not communicate in any fashion with any third parties.

 

But I wouldn't look for many (if any) CA's to be patient and/or cooperative. CA's don't care what led to your situation. They're only concern is to collect as much money from consumers as fast as possible.

Is there a template somewhere for a letter to send to the CAs asking them to 1) only communicate in writing and 2) not communicate with any third parties? Also, what is the purpose of #2 - what third parties would the CAs typically communicate with and can this hurt me in any way?

 

Finally, I was kidding about the patient and cooperative part Smiley Happy I just want to maintain some positive communication with them in hopes that they refrain from suing me because they think I'll pay without the costs of litigation.

CA's often call employers which can be very embarrassing to you. They will contact friends and relatives and they don't need to be involved in the process.

 

I don't know of any particular template for such a letter to the CA's. It doesn't have to be anything complex. Just tell them that from this point forward to stop all phone calls and to only communicate with you by mail. That's all you need.

Marine - Is there any magic language to the letter or can I keep it simple, essentially using the language I stated above (i.e. stop calling and only communicate in writing, do not communicate with 3rd parties, etc)??
