I had a credit card collection from BofA that fell off all bureaus two years ago. The DoFD was nine years ago, way past the 4 year SoL in my state FL.
These bottom feeding scumbags are calling multiple times a day from spoofed numbers. First time they called I refused to verify any info and the calls have since ramped up.
Does this border on harrassment since they SoL has long passed?
Simply tell them in writing to quit calling you. 1) Are they calling a cell phone b) if yes did you give permission c) if no permission tcpa vilation 2)spoofing violation. In some states trying to collect on SOL debt requires disclosure but is not harrasement til you tell them to quit calling.
There is no need to rely upon or show any improper acts by the debt collector, such as harassment, in order to require that they cease calling you. FDCPA 805(c) provides that a consumer can require a debt collector to cease further communication with them without providing any reason or basis. All that is required is that you send them written notice instructing them to cease further communication.
Make sure to cite FDCPA 805(c).
