I recently asked bank of american to investigate an account that was closed. BofA bought the account from Citicard. I paid this account of about 4 years ago. After that time my wallet was lost and I called to cancel my credit cards. Well within that time the account was charged 7, 000. I called and told them that I wanted the account investigated. I received a letter stating that after a through investigation of my fraud claim, it has been determined that records indicate that I attempted to settle the outstanding balance thereby acknoledging my obligation to pay. This can not be. I paid the account off prior but I was not aware of a balance. The account should have been closed. What can I do about this?
I would send a letter to the CEO. Include any proof you may have as to the steps you took. Paying it off, wallet being stolen, cancelling and closing your card, when those charges were made, etc. Let them know that you continue to dispute the account and that you did not attempt to settle the debt. Be as detailed as you can.
Did you ever file a police report? If you didn't, I would still do that. Once you file a report, if you have not done so, file fraud with the CRAs.
Send a copy of the police report to the CEO also. They may question why you waited so long to file it.
When you called after your wallet was stolen, did they tell you there was a large balance on the card? When were these charges made? Before or after the cancellation.
How were the transactions made? Where? You need this information. Contact each place, by mail, for a paper trail. Tell them these charges are fraudulent and you are disputing them.
I had a similar situation. My CC was charged for some things I never bought. I disputed with the CCC. They took off the charges but put them back a bit later. When I contacted them about it, they told me they had gotten proof from the creditor that I made the charges in person with CC. I asked for a copy. After I received them, the print out clearly showed it was not me. It even had a different persons name on the paper. They lived in a different state even. All of the charges were removed.
My point is, if you can get copies of the transactions from the creditors, there has to be signatures on them. They will clearly not match yours.
