I think I've got it, but I need a little help...

HI ALL!

I'm new to the site as you may see. I've read through about 50 postings so far and I've learned a tremendous amount of knowledge thus far. Thank you to those who answered everyones questions. I think I have he lingo down as well, LoL.

My problem is: I have a few CC's that have been CO (due to me being young and stupid) and I have CA's reporting those AND the OC's as well. I'm willing to make payments on these debts, but I also want the to fall off of my CR once I do so.

If I understand correctly, I need to negotiate payment terms with the CA first and request a PFD?

I've already scheduled a pymnt plan (2hrs before discovering this site!!) with Jefferson Capital Systems, LLC and they gave me a reduction, and they'll issue me an Emblem MC CC.

Would it have been wise for me to request a PFD first?

Re: I think I've got it, but I need a little help...

Hey thanks for the reply!

I should do that in writing I assume? Also, is it ok for the OC AND the CA to be reporting the same account on my CR? Can I get one of them to drop that off with a DV?

I've been reading through this site and I'm still a bit confused if and when I should send a DV?

not only that make sure the letter is on company letter head and sign by person who can make the agreement also that will be del. to all three cb. do not send any money until you get the letter.

yes. if the oc sold your account to another company, the new company can report on your cr plus added fees etc. if you pay the new collection company they may pfd but the oc account will still be on your report for 7 yrs from dofd. you may ask them to del with a good will letter. and yes always dv everything. that how i got about 16 items removed from my cr in about 6 months bug the hell out of them, until they give up.

Re: I think I've got it, but I need a little help...

Thank you! I'm starting to see some signs of light from this darkness.

I have some medical collections on my CR. These are from an auto accident on April 4th, 2006. The SOL for my state is 3yrs.

Is there anyway that I can DV these agencies? or is that a bad idea?

Re: I think I've got it, but I need a little help...

Before doing anything......what is the DOFD?   This is set by the OC and will be reported!

What is your SOL?

Yes you can have 1 OC and 1 CA report the same debt. It doesn't matter if it has been assigned or sold.

Check your state law on CAs. Do the have to be licensed or bonded, If so are they?

You should always DV a collection before anything else.  Always try to work with the OC before a CA.

Never talk to a CA  they will lie to you.  Everything in writing!!

Re: I think I've got it, but I need a little help...

Happy Days - Thank you! The SOL in my state is 3 years. All of my Medical debt is from the hospital in which they took me too, and the helicopter ride to get there.

Let's just say, hypothetically, the DOFD is longer than the 3yr SOL.

I'm sending DV's today to everyone except the Medical Debtors becuase I am unsure if I should or not and I don't want to wake a sleeping giant 'ya know.

Everything from here on out is written and CRRR.

Re: I think I've got it, but I need a little help...

I mailed my DV letters CRRR to not only the CA but the OC's as well. If it was showing on the CR then it got a DV letter. (See example below)

Re: Account # **********

To whom it may concern,

In a recent review of my credit report, I discovered that your company has placed derogatory entries in my credit file. I dispute your claims in their entirety and request full and complete validation
pursuant to the Fair Debt Collection Practices Act, 15 USC 1692g Sec. 809 (b) that your claim is disputed and validation is requested. Be advised that this is not a refusal to pay.

This is NOT a request for “verification” or proof of my mailing address, but a request for VALIDATION made pursuant to the above named Title and Section. I respectfully request that your offices provide me with competent evidence that I have any legal obligation to pay you.

If your offices fail to respond to this validation request within 30 days from the date of your receipt, all references to this account must be deleted and completely removed from my credit file and a copy of such deletion request shall be sent to me immediately

All communications in this matter are to be in writing only, and sent to the address provided on this letter

I also sent payment of $225 to Jefferson Capital Systems, that promised to give me a reduction of $187 on the $600 that I owe the for a CC debt. Therefore bringing my total amount owed down to $188 that they'll put onto an "Emerald Mastercard" to start rebuilding my credit. They also said that they would PFD.

Hopefully, if everything works out, I'll have 6 negatives removed. That would leave only the medical debt which I'm going to try and work a deal on and pay it off ASAP.

I find myself checking the mailbox everyday and double checking my tracking #'s for the DV CRRR letters that I mailed. I'm anxious to get these things removed so I can continue living my life. I'm 25 yrs old and I make great money for my age, I'm college educated with no criminal history. It's time to have a CR that shows the type of person I really am.

Re: I think I've got it, but I need a little help...UPDATE!

Hi All!

NCO - GONE (just disappeared one day)

RJM - GONE

Capital One - BS!

Jefferson Capital Systems - GONE

Zenith Acquisitions - Remains

Chase - Remains

I received responses from 2 of the companies that I DV'd! Capital One claims that they can't find me in their system and to fill out this form that they sent to me and return it to them so that they may find my account. I call BS! The other was from RJM, they are deleting everything from my CR! It hasn't happened yet, but I have it in WRITING from them that it will occur, and it it doesn't, to send a copy of the letter to all 3 bureaus. I'm excited!!

What should I do about Capital One? They're letter is requesting my social and other "private" info. Any suggestions anyone?
