Thanks, you give such great information.
 
To clear some things up.  I paid the Discover and Cap One on my own.  This latest account they levied the money.  My bank charged me an additional $50 for this.  I found out about this judgment when I found the money missing from my checking account.  I remember someone coming to where I lived to serve me regarding the Discover and Cap One, but I never got anything regarding this new judgment.
 
I live in Nebraska, can they simply serve you my leaving it at your door or something or do they need to hand it to you directly?  Thanks for your help.

I have a similar situation. I received a judgement and a court summons in the Spring. I was so scared of what would happen, I did not go. Now I keep getting letters in the mail from a lawyer. I want to resolve this and pay it off. What should I do? I only owe $1446.47. I want to clean all of my credit problems. I feel so overwhelmed!! To make a long story short, I opened most of these credit accounts about 4 years ago and I was paying them, then I got cancer and could not work for 4 months due to chemotherapy. So during this time my husband and I took out a HELC to live on while I was sick. We have always paid that on time but, with just enough money to live on, the credit cards took a back burner. Now three years later I feel so overwhelmed by all of my credit cards charge offs, the judgement, my medical bills , I just dont know how to start to fix all of this. HELP!!!! Cheryl

You need to request from the originating court Proof of Service. See if they have your signature.

According to NE process law, failure of proof does not affect the validity of the service. Smiley Mad

Personally, I've not seen a case where the court doesn't seem to give a durn if you were served or not. I have to admit, I'm seriously stumped. I'm still looking into that one.

Donks, I have no experience with what you're going through, but it all seems rather unfair.  I hope you can get this sorted out.

From what I can tell, what the attorney did was illegal. I didn't think they could put a lien on your checking account and CERTAINLY not withdrawal funds without permission. Correct me if I'm wrong, I thought they could garnish your wages by taking it out of your CHECK from work, not from your actual checking account. Yes, I would do as Wondering said... and do it ASAP TODAY!

I think I'm going to really need some help on this one.  I have no idea where to begin fighting this.  If anyone has any insight or a list of steps that I should do, please let me know.  I'm open to all suggestions.  I need alot of help on this one.  Thanks in advance, everyone has been great in this forum.  I wish I would have known about this years ago.

I would suggest you go to the Clerk of Court where the lawsuits, judgements, etc. were recorded.  Obtain copies of everything on record.   Once a judgement is paid a Release should be filed with the Clerk's office....this shows the judgement has been paid in full.  Make sure you have copies of all documents on record with the Clerk.  Put them in a safe place as I am sure you will be needing them at some point in the future. 
 
Clerk of Court offices do not always report to CRAs on a monthly or even a semi annual basis.  Sometimes reporting to the CRA is outsourced from a Clerk.  Long story short, you need the Releases in the event these Judgements should appear/reappear on your CRA at a later date.

Dont give up. I can feel your pain. And yes, this cr stuff is hard work, but keep at it.
I got papers they were going to take me to court, so I worked out a plan to pay. I did pay for awhile then got behind. All of a sudden, they had $1200. pulled out of my bank. I called the bank and they said they could do that since the judgement was signed by a judge.
 
The bank lady told me tho, once they pull out of the bank, whatever they get is it. They can not pull again. In this case I owed $1600. they pulled $1200. and on my cr it reads paid judgement. Hope this helps
