Still working to get my friends collections deleted. He made some calls and these 2 companies refused to give him the agreement in writing. He said they told him he had to pay in full first then he can request a deletion. I told him to hold off because I didn't believe they would object to giving him this agreement in writing first. Can anyone share their experience of PFD with these 2 companies?
Most if not all CA's wont send letters. They have agreements with the CRA's to report accurate info. But they delete anyways. They dont want soild proof like a letter that can be used against them. They both have been known to PFD. Get it in the past.
If it helps make a recording of the phone call from start to finish just in case. IC Systems will definitely do a PFD for sure.
Hi- I just paid 2 Caine & Weiner off in full and received both of my letter. Once you have paid them in full they will have you to log onto their website to request your letters. You will receive your letters by email within 3 business days.
I had 2 from IC Systems last year that I was able to get deleted right away by sending them an email threatening legal action if they did not verify/validate the debt, including sending me copies of my original signed contracts with the OCs. As soon as I threatened with legal action, the sent me a letter saying were ceasing all collection activity and both collections were deleted from my credit reports within 2-3 days. My best friend also had a collection from them and she did the exact same thing with the same results - deleted. You have to really play hardball with them, but they will delete it if you're assertive enough. Their email address is consumeraffairs@icsystem.com.
If I may interject here. I keep seeing in posts that say a creditor whether it be an OC or CA cannot remove accurate information.
The only requirement in the law is that IF they report, it must be accurate.
Anyone owning a debt has the prerogative to report or not report. There's nothing written on the law that says they must report.
When a collection agency owns a debt and deletes after being paid, they are within their right to do so because they own the debt.
Just because credit bureaus have internal policies does not preempt the law.
The collection agencies that are legitimate and making money are the ones that offer pay for delete.
Also, people are misconstruing SOL and the ability of a creditor to sue.
The statute of limitations to sue is for what they call timebarred debt.
This is an affirmative defense. Meaning if you get sued you have to show up and inform the court it's a Time barred debt.
Collection agencies Sue all the time even after the statute of limitations have run out because of this. If you don't respond to a collection agency's lawsuit and inform the court that it is time bar debt you will lose.
Mainly because the court has no way of knowing that this is a Time barred debt and the ca takes full advantage of that.
Most legitimate collection agencies will acknowledge a Time barred debt.
But again, there are some that don't.
Just FYI.
I was leery with ICSystems as well, but I paid, received the Reciept the following day and was told the PFD letter could be requested in a 'few' weeks, to which I called exactly 7 days after paying and was emailed the PTD letter 24 hours later. They are legit, they just have their ways, no deviating. The item was removed from my CR exactly 20 days after I paid. Hope this helps. Good luck!
