In need of some desperate help!

Good morning, alright, long story short,  I ordered direct TV through Qwest and never received what I ordered. Therefore I cancelled my services with qwest.  Qwest was really nice and credited my account.  Direct TV being the a$$ holes they are, charged me a $260 early termination fee. WTF, oh well, so I verbally agreed to pay $100 towards the fee of $243 ($17 credit from Qwest).  Direct TV received and collected my payment on 3-20-2009 per my bank, unfortunately the never credited it to my account.  I have been fighting with them over this since march. I refuse to pay anymore until they credit my account. Well direct TV sent me to collections on 4-2009 per cra's. After  a million faxes and conversations I think I got if fixed. Oh no, all direct TV did was update the ca that a payment was made on sept 2009.  per exp. Report states: d/o:4-2009, rep./since.:5-2009, d/status:5-2009, last/rprt:9-2009, org amnt:$243, and recnt blnc: $143 as of 9/2009.

 

since I made a payment of $100 dollars on 3/20/2009 how can this be accurate reporting and if it is considered a violation of the fcra how do I get it fixed? 

Direct TV is not being cooperative and from what I have read on here I do not want to call the ca.

I'm confused, it looks like they did credit your payment...

 

Or are you trying to get them to remove it because they never credited your initial payment and sent you to CA?

Let me try to clear things up, okay, I paid direct TV on 3/20/09 and they did not credit my account until 8/5/2009 and during this process they sent me to collections.  However the amount stated is invalid since my payment is not reflected until august.  instead of direct TV fixing everything they just made it look like a made a payment in September. I believe since my payment was made before it was sent to collection and its direct TV's fault that they did not credit my account until august that everything reported is incorrect. 

 

I hope this makes sense.

Ok now it makes sense!

 

Did you send a check? Does your bank hold pdf copies of all checks in their online banking system??

 

If you can provide them with a bank statement or cancelled check or pdf file of the check that has the date written on it, I believe they have no choice but to remove it because you would have legal documentation for recourse.

First of all, how can they legally charge you for something you were not receiving then turn around and charge an early termination fee for it.?

 

In order to charge an early termination fee you had to have been receiving their service.

 

You are a lot nicer than I would have been that is for sure.

 

At this point, I think I would send them an ITS letter, file complaints with the BBB and your states AG.
