Judgement and collections question

It looks like I'll be getting around 1000 dollars back this year from the government. I was hoping to settle my AmEx judgement for around that. It's about 5000 dollars. Do you think they will take a 20% lump sum payment?

Also, I have a few CAs on my report reporting as the original creditor. Can they do that? Will a debt validation request renew the sol after the sol has passed?

One  more thing. Did anyone see a good score boost after taking care of their judgement?

Thanks! =]

Re: Judgement and collections question

Judgements are not nearly as easy to settle as unpaid debts. Unless you are considered "judgement proof", meaning you have no income that can be garnished and no assets to sieze, settlement is not likely - but its always worth a shot.

Its not legal for CA's to report as OC's but there are many that try. Theytry to do so by passing themselves off as 'factoring companies'.

I live in a different state now. Will It be harder for them to collect or garnish my wages? Since I can only offer a fraction of what I owe I'm worried it will get the ball rolling on that stuff for them.

Re: Judgement and collections question

They would have to get the judgment 'domesticated' to a court in your state in order to have jurisdiction to get a garnishment order. I have no idea how difficult that is to do. If your current employer is listed on your credit reports have it removed - just in case. No sense in making things easy for them.

What can be done about a CA reporting as the original creditor?

A CFPB complaint will usually clear this up.
