Hi all,
A little background... I lived in an apartment that I ultimately wasn't able to afford anymore, so I had to move out. Basically got kicked out, broke my lease, and was served a judgment for back rent in early 2013. The past due rent and fees was ~$2500.
Flash forward to now: I've moved, new (and much better paying) job in a new place and I'm applying for apartments. Credit gets pulled and the judgment comes up. I call the apartment complex to get my head around the balance since it had been a little bit and they couldn't find my account.
They referred me to the law office that handles the eviction cases... the lawyer bounced me back to the apartment complex. Talked to the complex and they still couldn't find anything. Turns out the complex was purchased by a new management company about a year ago, and have no record of it. The contact in the office I spoke with said she's going to keep trying to find something, but is coming up empty handed now.
My questions to yoyu:
If I wasn't in such a hurry to move, I'd dispute it or ask for a validation of debt and go from there. But I'm looking to move within the next month and would like to get this cleared up so that I can continue on with the application process.
PLEASE HELP with advice! Thank you.
I would contact the court. In many jurisdictions, you can pay the court directly in order to clear the judgement, if the plaitiff is being "difficult" to pay.
To follow up on Norman's advice, you will need to show the judgement court what efforts you have taken, so create a paper trail of effforts to contact, showing that you have taken reasonable procedures........
