Re: Medical Collections Question....

mberry117,wahmom,jewelrygirl and kidshelper,

Only paid collections can be deleted!    unpaid can not!

HIPAA letters must be used and in the correct order!!

If you have an unpaid medical debt....do NOT contact the CA!!!

           Unpaid:
Call the OC and get the correct amount owed. If the OC has more then 1 bill....each is seperate & needs to handled seperate!
           Examp:    hosp  1/2006     $200
                           hosp   3/2006     $500
You would use an HIPAA letter and pay with 2 checks  with each account # on them!

If you can not afford to pay all at one time. Make payments to the *OC* only!!!

You must not skip a letter. HIPAA is very clear about this.

The Pre-HIPAA  is a disput with the reporting of the CA

The next letter is only after the dispute is completed & not deleted. One of the inserts must be used!

INSERTS

............................................................................ .............................................

(insert a)
Enclosed please find my remittance of ($___) for payment in full of this account.
(insert this if the payment is less than billed)This payment in full is for services as per the attached fee schedule from XXXX XXXX)
Health Care Billing Charts
Please note, my remittance is payable ONLY to (hc provider) and may not be signed over or transferred to any third party collection agency, as this would constitute an additional violation of HIPAA and State Privacy Act rules .

Copies of this correspondence and a copy of the remittance check may be used for any further actions with State or Federal agencies

.......................................................................... ..............................................

(insert b)
This account is in error.
It has either been paid, is a billing error,or was not transmitted in a timely manner to my insurance company.
It is not a valid bill and has been properly disputed, therefore I request complete deletion from all your agent (name of CA)'s records and archives.

.......................................................................... ...............................................

(insert c)
This is not my account,
It has been billed to me in error. and has been properly disputed, therefore I request complete deletion from all your agent ( name of CA)'s records and archives.

Even after the CRA verifies the amount....they do not always get the info. from the OC as they should............I would call the OC and get this amount.

Remember that some states have no SOL for hospital debt.......other debt has SOL.

So If you owe and within SOL   Pay ASAP

Any payment ( payments or PIF)   first dispute & then  you can use the second letter  to PIF or state paid.

Be sure that payment should be made by check (1 check per account)  made payable to the *OC*

On the back of the check write....for deposit only!

Re: Medical Collections Question....

Thanks HappyDays.  I am hoping that my stuff will get deleted after the Pre-HIPAA letter.  I am not going to send that until I pay the OC in September.  After that, things get shady for me.  I work for the OC so I can't really go through the entire HIPAA process for risk of losing my job.  I'm hoping that the letter to the CRAs will do.

Re: Medical Collections Question....

HappyDays I think I am beginning to understand.  I want to get them paid for delete really, some are more than 4 years old which is past my SOL in Delaware.  The one I posted has been in the last 2 years and I want to get it paid off.

Thanks!

Re: Medical Collections Question....

Ok, I called the Hospital billing department and they are willing to work with me, so I don't have to do anything with the CA's!!!  So I will pay them off and then get them removed! (I hope!)

Re: Medical Collections Question....

DH has 3 separate medical collections on his CR.  They are all PIF and had been paid to the CA.  I also contacted the CA's in the past.

DOES THIS MEAN I'D BE WASTING MY TIME FOLLOWING THE HIPAA METHOD DISCUSSED IN THIS THREAD SINCE I CONTACTED THE CA IN THE PAST?  I already sent the pre-HIPAA letter for 2 of the accounts and each CBA removed only one of the accounts but verified the other.

I just finished preparing the second letter, but now I wonder if I should waste my time sending it out.

Re: Medical Collections Question....

Yes send it to the OC   CMRRR      the legals say * you might lose HIPAA when contacting a CA....it does not say *you will lose protection*

was it EQ that did not delete?

If you're reply was to me, then the answer is that EQ and EX both removed ONE and verified ONE of the TWO medical TLs that I pre-HIPAA'd.  TU removed the one that EX and EQ verified, but verified the one that EQ & EX removed.

We PFD'd the one that TU verified, so I'll call the OC on that one again.  I'm printed out HIPAA letter #2 for the other of the two accounts that I pre-HIPAA'd.  I'll mail that out on Monday.

There's a THIRD medical collection that was PIF to the CA back in March.  I haven't touched that one yet.  I plan to send the CBA's a pre-HIPPA for that one since I had 50% success on the other two TL's that I pre-HIPAA'd.  If the CBA's don't remove the third TL it could get complicated because that CA was reporting a single line for multiple OC's.  I wouldn't know which OC to contact with HIPAA letter #2 if the CBA's don't delete that TL with the pre-HIPAA letter.  But we'll cross that bridge when we come to it.

Re: Medical Collections Question....

Remember in the future  if needed....if a CA is reporting multi-accounts  send seperate DV letters . 1 for each accounts.(for other then medical debts)  And if you pay use the PFD for each seperate.

Re: Medical Collections Question....

hi I am fairly new to this site, but have been reading  alot of threads to gain insight. I did read this entire thread as I have a  similar situation.

I am confused as to what info is actually shown with regard to medical CA accts with regard to HIPPA and FCRA .

The credit reports I received in the mail from CRA's show all medical info such as facility, dr name, etc.

Although, a copy of a merged report from a mortgage broker who is trying to refinance my mtg shows almost all medical accts as "unpaid medical" with none of the  info that is displayed on CR from CRA.

Only one displayed "Suncoast Adv Rad".

So is this info on CRA's CR only for:
 a)   our viewing only
 b)   not supposed to be there at all
 c)   visible to certain entities only for example not mortgage brokers pulling reports
 d)   none of these (but what is the correct answer anyway?)

thanks for any input

Are you saying the reports your mortgage broker pulled didn't show the actual name of some of the OC's (physician, hospital or other facility) on your collections? Are you absolutely sure? There has been some debate as to whether the reports we pull are different from the reports lenders and other creditors pull. I'm trying to get to the bottom of this.
