Medical Data Systems is a CA that is reporting on all 3 credit bureaus. I disputed the accounts and they came back as verified, of course. I sent them debt validation citing the FDCPA and Texas Finance Code. This was sent certified mail and was received in their office on July 8, 2013. The have still not responded to my requests. I filed a complaint with the CFPB as well as the BBB. The BBB said that it was an issue that needs to be addressed with the CRA. My question is, how long does it take for the CFPB to investigate and respond to complaints?
I have seen some resolved quickly and others where they extended the dispute time to 60 days.
If they violated the TFC, be sure to file a complaint with the TX AG.
They did violate TFC 392. What is the resolution time for that? I have a deadline to meet and this item is hurting me. It was also my understanding that once an item has been disputed, it should be removed from credit files until the dispute has been resolved. Is this correct?
No, nothing in any statue or regulation states that.
If it is an OC account certain aspects of the account are removed from scoring during the dispute but the account is not removed.
Collections and PRs are fully factored in and will remain on your report unless the dispute is resolved and removes them.
I filed a complaint with AG before about a compnay that is not even licensed to collect in Texas. AG said that the only monitor trends and do not act on individual complaints
Yes, I read that too. There is a comment on the AG site that says they normally don't get involved with individual complaints unless the complaint warrants it.
What I find disturbing however, is that is what the state AG is for, to make sure their statutes are followed. Why make a law and not enforce it.
My question is, what means of recourse does a person really have if the AG is not willing to act on wrong-doings?
If the wrong doing is based on state laws and the AG won't get involved, the only other thing would be to file suit against the wrong doer.
Filed a complaint with the CFPB on August 26. I received a response from them today saying the company has responded. Company said that they reached out to OC and the OC could not find verification of this alleged account. They then stated that they are ceasing collection activity, returning the account to the OC, and will be informing the CRA to delete the account. Hoping the CRA will delete within a few days.
