I recently disputed an account with Equifax. It was a gym membership from 2003. DOLA is 11/03. I canceled the membership because I moved away and there was no gym within 30 miles of my address.
When I disputed with TU and EX, it was deleted. With EQ, they OC has now marked the account as 60 days past due. It was last reported late June 2006. The bal is $0 and the status shows paid account/zero balance paid by dealer . How can I go from 90 DPD to 60 DPD with no activity in almost 3 yrs. This company is trying to screw me over. It's working. This is the only baddie on my credit. Now it's a recent delinquency. Ugghh!
Anyone have some suggestions aside from a DV? Already done that. I'm not paying them one dime. Worst case scenario, I'll wait until 2010.
I just received a letter from BBB stating that my complaint is closed. Attached is a letter from Fair Financial, here's a paraphrase.
Claimant never told us about her move or wanting to cancel membership...Lie
Claimant's last call to us was in Jan 2004...Lie, I talked to 2 different people just this past April
The rest is just fluff...until the very bottom:
"In the spirit of good business and being that the gym where the membership was maintained has since closed, we will delete the tradeline from Ms. X's reports.

Re-aged means the DOFD has been changed.
I guess I was wrong to say re-aged. The status was updated and now reads 61-90 past due. I've contacted this company directly, Fair Financial. I called after they updated on my reports as a baddie. I was told to contact the gym where I had the membership. They've closed shop. I called Fair Financial back, they told me they have no record of me canceling with a valid reason and the gym granting the cancellation. I was told a manager would call me back. Still waiting on the call. Seems like the former manager didn't send anything to Fair Financial and now I'm screwed.
I don't know what to do. Anyone have a suggestion?

Who is Fair Financial?
Fair Financial services retail/installment contracts. I guess the OC is Fair Financial and the gym is just the dealer for the contract. It's like I bought a car from Smith Toyota, they close, the car is returned because of a recall, Smith Toyota is closed but I still owe Toyota Finance $10k because they didn't receive the necesary paperwork 6 years ago.
Fair Financial is reporting $0 bal, $0 past due, currently 61-90 dpd. I just don't understand how it can be 61-90 dpd with a $0 bal. It went from CO in 2006 to 61-90.
Frustration is all I feel. This serious recent delinquency is really hurting my score.
Was your contract with the gym or Fair Financial?
I googled FF and according to their website, they provide accounts recievable management, which includes "professional collections". So, I'm not sure they would be classified as the OC.
Unless they are collecting for a debt owed to them, according to FDCPA, they are a debt collector.
Well, when I had the membership, I did send the payments to them. So the were the acct receivable, and now they are the collection agency. Think I can DV, especially with the gym where I had the membership is now closed?
I just filed a complaint with the BBB in Akron,OH about this issue. It's ridiculous, I can't seem to get a return call or any supv/mgr to talk to me. The info they have is old. They just updated my report to 61-90 days past due, but that was from 2003. How could they do that!!!
