My Progress trying to rebuild (Update)

So I have been working hard rebuilding my credit and have had some challenges along the way and my rebuild is far from over......

 

I am in debt close to $100,000..... Yes that's right $100,000 of debt which is credit card debt and part of it is a personal loan..... Most of the balances are interest and late payments that racked up before they charged off......

 

Thing I have accomplished:

 

Paid off Car in December 2018

Settled and paid off settlement of one of my Amex Cards with a smaller balance

Working towards a Settlement Payment plan on another Amex Card that will be paid off by the begining of 2020

Paid off another small credit card

Will pay off an additional small credit card within a few weeks.

 

 

I was able to obtain 3 credit cards not so great ones but better than nothing all things considdering..... I got a Total Visa with a limit of $300.... First Premier with a limit of $500, and First Progress Secured with a limit of $200...... My credit score is about a 486 which is better than the 320 it was back in the begining of 2017.

 

I have been considdering Bankrupcy to wipe out everything and start over but I'm still not sure..... I am ignoring almost every credit card company and debt collector except the ones I wanna pay off and the current credit cards I have...... Amex tried to sue me one of the business credit cards I had that charged off but I didn't show up to the court date, and it's been a few months since and nothing has happened..... There's even one credit card I had with PSECU that charged off, I haven't paid on it in over a year and the collection company that has it hardly makes any attempts to contact me.... like I get a phone call like every few months and barely get anything in the mail reguarding it.... I'm wondering if they don't care if I pay or not?

 

I'm not really sure what I should do, but what I am doing currently is working on paying off smaller balances which frees up income which will allow me to see what I really want to do about my debt..... At this point my score is going up weither I pay old debt or not..... So I am wondering how much it matters. Smiley Indifferent

First of all, you came to right place for help rebuilding. I am on rebuild 2.0 now and digging out of almost almost 400k of debt. 

Don't feel bad...we have all gone through tough times before. 

 

Do you make enough money to start an agressive paydown attack? I ask because when I started, my monthly interest was $1200 just for the revolvers and I picked up a 2nd job; that income is dedicated to debt paydown. If you need a paydown plan/calculator, I suggest https://www.vertex42.com/Calculators/credit-card-payoff-calculator.html. One of the myficoers sent it to me and I love it. It calculates interest for different pay down plans (snowball, avalanche, etc.). 

 

I am not an expert on bankruptcy, but if you post a detailed list of your tradelines, I am sure someone will be able to provide appropriate advise and next steps. Just remember, you are not alone....if I can get through mine, you can get through yours. Happy Rebuilding!

If you had a court date and did not show up, they most definitely got a judgement and can pursue garnishment at their will. I would check with your local courthouse and see if/when the judgement was obtained.

At one point for a 6 month streatch in 2018 I worked a total of 4 jobs counting my business and tried an agressive paydown and the only agressive paydown I was able to stick to was my car payments, I started paying $95 weekly until it was paid off.... then I took that $95 a week and throw it towards a small balance credit card that will be paid off in a few weeks..... I only work 2 jobs now counting my business but I am currently looking to replace my regular job with a better paying job to help tackle this and maybe even use some extra income to grow my business so I can make even more money.

Well now that you didnt make the court date. They will go for garnishment of your pay like mom said. Failure to appear wasnt the best thing to do. Its hard to grind it all down to the best course of action. You have 100g's in debts though you get more credit cards? Sorry trying to be sensitive here. Thats not the best course of action. I myself dont like to say nor any of us really do say yeah file for BK. In your case I think its time to find a lawyer. Missing the court date I feel is the icing on the cake. Without knowing who and what you owe and how many cards and payoffs going to 2020. Getting vulture cards while in debt. I think you know where this is heading. Good Luck!

I couldn’t agree more with FireMedic1. Step back and reassess what you posted. Glaring things like not even going to a court date, not caring about credit cards other than AmEx, etc seems to show that you may not have a full grasp on the situation. You need to write down every debt - who is owed, how much, etc and look at the numbers. Then weigh that against your income and realistically determine what you can pay. If you can’t dig out in a few years from all of it then you need to look at filing a BK7 if possible. If not, within that few years you will very likely receive more court summons which can and will result in more garnishments. I have dealt with that in the past. Was garnished to pay off $5200 of debt and it sucked, to put it bluntly - and it was for less than a year. I couldn’t imagine it for years and years on end.

I would consult a BK lawyer today. Unless your income is very high, a realistic payoff plan for this amount that allows you to avoid court, lawsuits, and garnishments is going to be next to impossible. Many people here have done it and have said it was the single best thing they’d ever done for their financial situation.

I've had the cards for a while some of the cards i've had since 2012.... and some with a zero balance where paid and closed years ago..... some of the balances are from a little while longer than before 2016 but 2016 was when everything went bad with late payments, interest and later when things started to charge off in 2017 and 2018.

To be blunt, you potentially have a lot to worry about. You have some significant balances that have been charged off. At least one creditor has filed suit in an attempt to make recovery. It would be safe to say that more will follow with similar legal action soon.

In my opinion, you need a serious plan for addressing each of these debts. If you don’t have the means to pay each creditor, you might consider BK an option. Either way, I’d act sooner than later. Ignoring the debt, or hoping the creditors forget about your debt, isn’t really an option.
