Hi Everybody
I am new to this forum but have been looking around and you all seem to give awesome advice! So here is the deal.
My husband had a court thing back in 2001-02 and had to pay fines in the amount of $430 for his punishment. At the time he was 18 and I guess his mom was taking care of it for him. So fast forward to May 6, 2009 we get an update on his credit saying that an account has gone into collections. I contact the collections office and they tell me that it was from not paying his court fines from 2001-02. They just received the account in February. So we went down to the court and paid the fines and then went to the collection place next door and said here is our receipt for paying the fees to the court can you please remove this. They told us the only thing they can do is report paid. I know this is not true they are just to lazy and lame to lift a finger. So my question is what letter do I start with and do I send it to the Collection Agency or to Experian?
Also he has 3 other collections that were all paid in 03-04 and are just sitting on his credit and say paid. Can he write a letter to see if they will take those off? I really appreciate all of your help. My husband has worked really hard in the last three years to get his credit up and I hate to see this ruin it all for him.
Thank you
If it is reporting as a collection it must be deleted approx 7 rears from DOFD. The date paid doesn't matter! DOFD should be 2001 or 2002 whenever the pirst payment was missed.
Too bad that they just received the debt in Feb. CRTP is approx 7 years from DOFD. You should be able to find out when he was to pay this. CRTP uses month & year.
I would mail them A DV CMRRR along with the past SOL letter.
On the 3 collections that he paid in 2003-04, What was the DOFD on them?
Well he has already paid the one that just showed up and that is why we are trying to get them to delete it because after only 2 weeks of it showing on his credit we paid in full. The only dates on there say 2/2009. When we paid it they said that they cant delete it the only thing they can do is say paid and we all know that isnt any better then having it not paid!
His other ones that he paid were, 11/2004, 3/2003, 9/2002 that is DO (Date Open)
Date open doesn't matter.
If you haven't yet, pull your free annual reports. You'll need a report directly from the CRA to see what the DOFD being reported is. EQ shows DOFD, EX and TU should show a removal date.
I ordered his free report a bit ago but I screwed up which reports that I wanted and just chose the one and now I cant get another free report because it looks like I already did.
Isnt there a letter that I can write the collection agency for this new one and say "Look I just paid the collection like not even a month after being notified of it, so can you please delete it instead of just saying paid?"
You should be able to go back on annualcreditreport.com and still order the other 2. I have had to exit the internet before and then go back and it allowed me to complete the other ones.
On the CA's, when was the court date-month & year? If it has been 7 years then they must delete the CA from the reports. If they are refusing to delete and it has been 7 years then he needs to dispute it with the CRA's due to CRTP having expired. On the others, when was he first delinquent on the accounts (with the original creditor) that caused them to become collections? Since they have been paid for several years now they really shouldn't be hurting the scores as much. You could always GW those and ask that they be removed. To do that you would write a letter directly to the CA requesting they remove them. Kill em with kindness in the letter and explain how he has worked hard to reestablish credit blah blah blah

Ok I will try that.

Where is a good GW letter that I can use? Also the new collection account that I am most concerned with says this on his credit:
DO: 2/09
Reported Since: 3/09
Date of Status: 3/09
Last Reported: 3/09
Type: Government
So even though the court issue happened the end of 01 they didnt report it to collection until 03 I believe is when the collection people said they got it but that they didnt report it until this year. Dose he have any rights at this point? We have already paid it we just want them to remove it now.
Please help it already dropped his score like 85 points!!!
Are you talking about a regular collection or a judgment/lein?
You need to know DOFD!
If you have an EQ report from EQ, it will show DOFD. On EX and TU it will show removal date.

It is not a Judgment it was fines he had to pay that was part of his punishment. He thought his mom was taking care of it and a year later they sent it over to collections but collections didnt report it to EXPERIAN ONLY until February of this year.

They didnt report to EQ so on EX it says 2015 removal!

If removal is listed as 2015, they are reporting DOFD in 2008.
Contact the courts, find out when the fines occured, what payments were made and when the payments stopped.
