Another concern I have is I've read lots of reviews online about the attorney's office that ordered the levy. They all say the office is impossible to get ahold of and some mention paying off the judgement but the payment is not reported to the court. I don't know how the judgement is not on my credit (husband went to court over 2 years ago and they pulled him aside to come up with a payment agreement but I'm assuming a judgement was entered since they were able to levy). What are the odds of the judgement staying off our CR's after the levy has been fully processed?

When they levy an account the entire account is not frozen, just the amount they want take. I went through this just last month with the state of California FTB. You have the option of contacting them to get the levy lifted - assuming they will agree to do that, or you can just wait for the levied amount to be taken out. In my case that took about three weeks. The bank should be able to tell you how much is being levied.

 

The levy is not likely to trigger anything regarding the judgement. It seems that the CRA's are currently 'under the gun' regarding the way they use third party companies for public records. I have a feeling a lot of PR's may disappear from reports entirely in the near future....

Thanks Norman! I went by our bank today to get a copy of the judgement and the levy request (or whatever it's called) and was told that it is only in my husband's name so they couldn't give me a copy. Is the attorney required to provide a copy of the judgement to the bank? Would there be 2 separate judgements (one for myself and one for my husband since we were both on the apartment lease and we were both served with a eviction notice back in 2014) or would both of our names be on a single judgement? I'm really hoping that somehow my name was left off the judgement back in 2014.

You'll be fine. The Mrs. and I have had this happen.  Once you get a hold of them and straighten out the missing payments, they'll release the levy. It's immediate. Then business as usual.  You'll be fine.  Most important is to get a hold of them and take steps to make good on those 2 checks that never were cashed.  Just a bump in the road Man Very Happy

Did your judgement have both your name and you wife's name? Was yours with a private creditor/attorney that you were already in a payment agreement with? We've tried calling the attorney's office all day and no answer or response to voicemails. Looks like my husband will be going there in person tomorrow if we don't hear back.

I'm sure they must be required to provide some kind of documentation to the bank. What exact form that may take, I have not a clue.

 

You should be able to search the court records online to find the judgement and get copies of it. It would be a single case filing, but it may or may not  have both of your names on it.

My take is :

They've taken all they are allowed,  per the judgement or they'd wiped out both checking AND savings

 

AND :

 

If there is a judgement and its not any credit report,  its not gonna show up now !

I'm going to the court house tomorrow to do a search to make sure nothing is in my name. We were planning to pay this off by December anyway... It's just the fact that they did it with no prior contact when we had been mailing the payments in as required. Apparently the majority of the money they took should be exempt since it was clearly my income but I don't know that bringing that up would be a good idea since they could probably turn around and come after me for the money by filing a lawsuit.

Just found out the judgement has both mine and my husbands name on it. I'm not sure why the bank is saying the judgement they received does not have my name on it though. We are just going to let them take the money to satisfy the judgement. I just hope the attorney's office updates it with the court so that it doesn't come up during title search while going through underwriting. Fingers crossed it will also stay off our credit reports!

What a mess... I was told by phone that the judgement had both mine and my husbands name on it but when I went to the court house today to get a copy of the judgement it shows both mine and my husbands name on the sheet from the lawsuit but then where the judge writes in the outcome he marked the judgement entered box but where both mine and my husbands name was handwritten in he marked out my name and initialed it. Is this because only my husband showed up to court? Does it have any affect on anything?
