Need help with Charge-off question..

Hi all,

Of the 3 reporting agencies, Experian report show that I have a credit card charge-off from Discover (opened over 10 years ago) that is set to expire November 2011.  My question: is it true that by the end of November, this charge-off disappear for good.  What can happen between now and then? Will it continue to report on Experian after Nov?  Any comments or suggestions are appreciated.  Thanks.

Bed debt on the credit report can be deleted after the Statute of Limitations had expire.  IDK if it varies state to state but typically after 7 years from the first negative indicator the mark can be disputed and it will be deleted from your credit report.

I think you might be confusing SOL with CRTP (Credit Reporting Time Period). SOL is set by each state and is the time period creditors have to bring a lawsuit for unpaid debt. The SOL varies from state to state.

 

The CRTP is federal law and sets limits to how long negative items can be reported.

It will disappear from inclusion in your CR after 7 years plus 180 days from the date of your first delinquency on the OC account after which you never returned the account to good-standing.  That is called your DOFD.  DOFDs regulated the start of the 7 years plus 180 day period for all charge-offs and collections.

It is one, single, date-certain, and cannot be reset by any other actions.

 

Does is disappear for good?  In one sense yes, and in another sense, no.

 

The exclusionary period for charge-offs and collections is a prohibition against the CRA including that item of information in any credit report they issue after that date.  So from the perspective of it being seen by others, or affect your credit score, it is gone.

 

However, it does not get deleted from your credit file.  Under the very limited situations where you apply for new credit or insurance involving a principal balance of $150,000 or more, or apply for a job with an expected annual income of $75,000 or more, FCRA 605(b) permits the requestor of your CR to request all items in your credit file, including all those items normally excluded under section 605(a) and (c).  It seems to be the general experience of those posting on this site that credtiors or employers rarely if ever invoke such requests for your full credit file under the provisiions of section 605(b), so for the most part, it appears to be a paper permission that is not invoked.  The point is that the charge off does not totally disappear.  It has a solid steel wall around it.
