First I'd like to say how great the forum has been, I've been rebuilding my credit since I messed it up in College.
Two years ago I had an outstanding bill from Nextel. I did finally settle for 80% of the bill. 221.51 in October 2006. I must have been speaking with Nextel in-house collection directly as Sprint has my payment as a credit card. Of course I did not get this in writing and there is no notes on this being a settlement. I just decided to make an 80 percent payment according to Sprint. In December of 2006 it aparently went to Enhanced Recovery Corp for collections. Which I never got any paperwork on.
Last year, July 2007 a collection company, AFNI was trying to collect the remaining $55.38. I spoke with them and Sprint and I thought it was over until I pulled my report this week.
Enhanced Recovery Corp has now placed it on my credit report as a debt collection.
I'm lost to what I need to do. Enhanced Recovery Corp said they will mark it as paid, but not delete it. Sprint is no help either on the phone.
Should I try a PFD letter to Enhanced Recovery Corp first? If I pay though the Sprint store and then contest the mark at the CA's made by Enhanced Recovery Corp, will the mark be removed or just noted paid after collection?
I don't care about paying the money, I'm angry because I thought this was over. It just does not make any sense why I would pay exactly 80 percent of the total amount if there was not a settlement offer.
Thank you in advance. Happy Holidays!
Jason
I would DV immediately enhanced recovery.
complain immediately online with the BBB, the FTC and the AG about Sprint (sending to collection a fully settled account) and separately about Enhanced recovery (trying to collect an non existent debt).
then i would call account receivables at Sprint\Nextel, ask to speak to a supervisor and tell them this was settled to full satisfaction and pull immediately from Enhanced. tell them you can sue them for breach of contract (debt settled to full satisfaction), violation of consumer laws for not notifying you of an attempt to collect an alleged debt (the remainder) before sending to collection, defamation of character for reporting a collection on a fully settled account.
then follow up with an ITS letter.
good luck.!!!
I think Sprint/Nextel gets off on this type of things. I have now a collection on my report from Enhanced who is representing Sprint. I also have another collection reporting for Nextel....THIS IS THE SAME ACCOUNT. I have just DV both collection agencies and will also be reporting them all to my AG and the BBB. Sprint wonders why I will not sighn a new contract with them and will continue to pay month to month.
We shall see what happens.
Ok, guess I have more then one login to the forum, anyways I am the Author of this post.
I sent a PFD letter and a DV letter end of Dec. I did not get any response back. I disputed with BBB, Spint and the CA's that had this account and got no where.
Since Enhanced did not respond to my DV, what is my next step? Do I send a letter to the CR's asking this to be removed? Any sample letters would be helpful.
Regards,
Jason
When you say you disputed with the BBB, what do you mean and who did you file against?
Have you filed a complaint with your AG against the CA?
I disputed Sprint, Enhanced and another CA that had the debt but never did anything with it. I have not filed a complaint with the AG just yet. Do I have anything to go with? Sprint does not show of any settlement being offered.
Should I do another DV letter then send a no anwser letter to the CRA?
