Need help with response to validation request

O.K. this is my 1st time here and i see that this site is very helpful, i would appreciate any help with the situation i currently face.

1.    I sent validation letters to a Collection co. "Portfolio Recovery". They are collecting for "CPL" power company ($600). They responded to my 1st validation request with a letter that stated only the amount, my name (spelled wrong), and i believe the company name, thats it. I followed with a 2nd letter requesting full validation or deletion of account, and also pointed out that i have never spelled my name the way they provided. They sent me a letter addressed with my name wrong again (last name ending with a z instead of an s) and stated they were unable to provide any information due to the fact that I have not provided sufficient information about account for them to perform an investigation of account. What else should i do? I can only provide what is on my report. I believe they are doing this on purpose and cant in fact validate. Its been months and very frustrating, any suggestions?

 

2.    A medical collection ($82) from 2003 shows its "current status" as 120 days late. Is this correct? how can it be 120 days late if its an old collection?

All they are required to send you is the OCs name and the amount owed.

 

It is up to you to determine whether they can collect in your state.

Its always better dealing with the (OC) power company, then a CA

 

As for your medical collection, you can use the HIPPA process.

Check whychat or Google HIPPA process

 

BTW, welcome to the forums.

 

If you haven't  already, check out the stickys @ the to top,do so. Try What steps Do I take? Do I DV? PFD?, also check out the Common Abbreviations.

would it be better to go for a PFD at this point? the CPL collection acct is described as a "joint", i dont know how this happened since it was under my wife's name at the time.

How old is this collection and is it still within SOL?

i believe the original amount was due back in 2005-06. The report i pulled a few months back had Aug 2008 as "date opened" under the collection company name. But the report i pulled 2 weeks ago now shows July 2009 as "Date reported" and Aug 2008 as "date assigned".

Date opened is the date the CA reported it to the CRA and date assigned is the date the OC assigned it to the CA.  Neither date has an impact on when it will be removed.  It will however impact your score as a new collection.
