Hi, this is my first post on the forum, but I've been stalking around and reading info for awhile. I took some info from other posts and used it to do a PFD.
I just got a response from a collection agency for a PFD I sent them. First off, they emailed me a letter on their company letterhead that has not been signed. Second, their phrasing seems a little off to me, so I just wanted some input form people with more experience.
This is what they wrote:
"This is to confirm That Aspen Sun Financial will agree to payment arrangement set forth today and will accept $243.10
For payment in full by 4/30/13
Upon receipt and clearance of payment this office shall hereby release any and all future claims related to the above referenced account. No further billing shall occur on this account and no other payments will be expected in the future
By Aspen Sun financial or any successor servicer for the above reference account. We will notify the credit reporting agencies as applicable that the account I settled infull and closed in good standing and to remove from credit file
It is understood by all parties that you agree to the arrangements set forth above and understand that if payment is not received by the date indicated above,th account may be subject to additional fees as provided for in terms of membership
agreement.
The following is given in accordance with Federal and State requirements
This communications is from a debt collector and is attempt to collect a debt.
Any information obtained will be used for that purpose.
Notice required by th Fai Debt Collection Practice Act,15 USC Section 1692,et seq"
Basically, my question is this the kind of reponse I was looking for and does it legally bind them to remove the collection from my credit report?
I don't want to screw this up and it's my first time doing a PFD.
I think this looks pretty good - they said they'll remove it. They're not required to do that, so if I got a letter like this? I'd jump on paying them.
I don't think a signature matters much. I did have a CA that send me a sticky note attached to a copy of the letter I sent them, so even getting letterhead is kind of a win.
Looks to me like it's a PFD agreement in writing.
