OC and CA both report same debt

OC reporting debt as charge off but shows balance of 1800.

CA shows as credit line as 120 days late, settled for less 0 balance.

 

Can I be hit for the same debt twice?  And can a CA report as a line of credit not a collection?  Can a CA report 120 late immediately from OC?

Yes the CA can report the most recent derogatory remark from the OC. The OC should be reporting the same trade line remarks as the CA is. Unless they sold it and should say sold/transferred with a 0 balance.

OC reporting unpaid balanced charged off as bad debt.  Balance $1884

 

The CA can report as a line of credit?  This baffles me.

CA reporting collection, 120+ late, settled less than full balance, 0.

 

How do I correct?

OC reporting of current balance always references the current balance on the debt they still own.

Debt collector reporting always references the amount of current debt that they have authority to attempt collection.  Alll debt collectors do not own the debt.

 

When the OC still owns the debt and it is unpaid, both can report.  They are reporting different things... one the debt, the other the amount they are authorized to conduct collection upon.

 

If the OC sells the debt, they miust promptly report the balance of debt owed to them as $0.

The reporting of the debt collector then becomes both the amount they are authorized to collect upon, and the amount of debt they own.

 

If the debt collector is reporting a $0 balance and paid, either in full or settled for less, they are required to notivy the OC, who must then promptly update the current balance of the debt to $0.  So you are correct that if the debt collector balance is $0 and they report satisfaction of the debt, the OC reporting of currrent balance must, soon therafter, be updated to $0.

 

However, be sure that the OC balance you are seeing as $1800 refers to the current balance, not the debt balance at time of carge-off.

They separately report the amount charged-off, which is retained under a separate code, and is not zeroed out if the debt is ultimately paid.

It is reporting of a prior, sticky amount that is not reduced based on later events.

The full report tradeline directly from the experian shows it was sold, yet still has the amount showing as a balance, not a charge off amount.
