After thanksgiving i may send you a message if you dont mind. i want to make sure i'm coving all my basis. Sorta share/proof read etc...if you dont mind. I believe in whats right is right. I rhink midland has made this more personal than what it really needs to be. Im pretty intellegent but sometimes my mouth can get me into alot of trouble lmao. Its why i norprmally wait a few days before responding. I just feel this guy is making it personal when it shiuldnt and obviously can't seperate his personal feeling from buisness.
Alright tonight im looking at my EQ report, i called them and they assured the same one i would look at online would also be the one they would send me in the mail. I am recieving it in the mail for my records.

2. It also is still reporting open and shows up in my open accounts section
3. They are stating i paid the original creditor, when in fact i didnt and paid midland
Also they midland are reporting a payment history and shows they charged it off in july, 2015...

filed my CFPB complaint after finally getting all my CR in the mail

I have been dealing with midland funding for around 6 months now to delete inaccurate information on my credit report. I initially started off with disputes with the CRA's only to come back as the information has been verified as correct. I then reached out to the BBB to see if I could get any resolution. After a month of waiting for them to respond and I had yet to hear anything. I reached out to the original creditor which was fingerhut on October 27th. I spoke with kari at fingerhut who then contacted midland on my behalf. Shortly after the BBB sent a 2nd request for a response from midland to reply, in which shortly after midland replied. Midland reply is basically stating that if I don't like it, then its not thier problem, take it up with the CRA's if I don't like their nomenclature that midland is compelled to use. Now remember I did take this up with them 3 times only for midland to verify the information as being correct.
I sent my response back to Gregory Gerkin, and was very polite and explained to him the situation of how its reporting on my credit report and that it needs to be removed. I even gave the reasons and how the report was reading. That they weren't an installment account or that midland isn't a factoring company. Mr Gregory Gerkin responded again shortly after with about the same response. Then accuses me of obtaining my credit reports from other sources, So to entertain Mr. Gerkin and I called each of the CRA's and ordered my reports DIRECTLY from them so there can be NO dispute to where I received them from.
My Gerkin has been unwilling, uncooperative in ANY and ALL attempts to correct this. Mr. Gerkin, I feel, thinks he's above all regulations that have to be followed. Mr. Gerkin I think has taken this personal and now just want to make it personal.
If I can also remind everyone about how Midland JUST had to pay millions in this very situation. There debt collecting attempts are unethical and so are their reporting "nomenclature reporting" as Mr. Gerkin feels he needs to belittle me in a round about way.
I for one am just not going to sit idly by and watch a company like midland destroy what I have accomplished. The have already cost me time, money, and opportunities for advancement with their tactics. And Mr. Gerkin is being obtuse about the whole situation.
As for the credit reports and communications between Mr Gerkin and I, I will attach those.
I will attach the one credit file because the other (depending on the out come) will be used at a later time. It is the experien report that I ordered, again directly from Experian. it is the most damaging to my credit report. Transunion and Equifax have issues too with midland.
Experian is showing this as an installment account, revolving term, and midland showing THEY charged it off in July 2015. I have never had any type of agreement with midland EVER, I had no payment arrangements with them, they are also a collection agency and cannot be a factoring company, they also cannot charge off something, again they are a collection agency.
Again these are DIRECTLY from the CRA's mailed my USPS to my address. The correspondence is with the BBB. I didn't want to write midland directly because I cannot trust them. A company who has been sued, fined not once but MULTIPLE time by consumers and the FCRA for breaking rules because they don't feel like they need to abide by any of them.
