Re: PFD Example Letter

I just sent a PFD to Asset Acceptance today. DF owes $425 for old SWB account. Scheduled for removal Nov 2008. Trying to get credit right for home loan. You would think they will accept since it is so close to the drop date, but you never know about these CAs. If they don't accept,we will just let it drop on its own. Their loss.

You're at your 7.5 year drop date, or your SOL date?

Re: PFD Example Letter

I got a response from a CA to one of my letters today. They said, "upon clearance of sufficient funds your credit report will be updated accordingly." This doesn't fully answer the PFD letter. To me this says they're reserving the right to continue reporting.

I was thinking I would photocopy their response and resend the PFD. I will highlight the key points in the PFD (full deletion, et cetera) and highlight their response (quoted above), and make a note saying that i request a more descriptive response.

This is an old medical debt. i had to visit an ER when i jacked up my shoulder. The bill is only $173 which is not big whoop, but i want the line deleted.

They also sent me a different settlement offer for $200. Different acct. number. I don't know what this is. I don't question that it's mine (probably is). But, it's not on my CR. I'm wondering if the SOL, or even the full reporting life (7.5 yrs) has passed on this particular debt. Any thoughts?

There's one more thing. I didn't send this CA a letter, but spoke with them on the phone. Painted in to a corner, I verbally disputed the validity. They sent me a settlement offer that involved depositing my owed amount on to a Visa card that they would have issued. anyone ever hear of this method to paying a debt?

Re: PFD Example Letter

Thank you for the letter.  I have some questions, my husband has credit card debt that was reported bad in 2003 and sent to a collection agency.  Since he was overseas and didnt check his credit report he didnt know about this.  They tried to garnish his mom's wages with a judgement (even though she didnt sign), we sent a letter and they dropped it.  I called them to agree on a settlement because Im tired of this CA harrassing everybody. They agreed on the amount I suggested, should I now use this letter, can I email it, or does it need to be registred mail? Do you have any other suggestions, I just want this off his credit report?

Re: PFD Example Letter

I have current accounts that have been charged off that show on my credit. The same charged off account is showed again by a another CA. My question is do I send the PFD to teh original creditor or to the new CA? If I only send it to the current CA how does the charge off from the original company come off?

Re: PFD Example Letter

Hi -

I have a couple of accounts that show "Date of last activity" to be in 2003....this is on my EQ report.....is this when the SOL starts? These accounts (which I am disputing) were opened in while i lived in CA....late 2003 I moved to TX.

Should I be clear of them suing me now.....I'm pretty sure the SOL has run out...but I just want to be safe....cause the only way I may get these things off my report ASAP is by offering a PFD....thanks

Re: PFD Example Letter

Hi again everyone, I sent out a PFD letter to First National Collection Bureau near the end of April. I have had no response from them whatsoever except for more phone calls trying to collect payment. It seems as though they completely ignored my letter. I'm wondering what my next step should be. Any advice would be appreciated.

Re: Collection Account for Original Creditor Account #: 00000xxxx

Amount: $25.00

To Whom It May Concern:

This letter is to inform you that the validity of this debt is disputed. I am not sure of the account number, as I have never heard from you regarding this account. The account number I have is the one listed on my Experian credit report which omits the last few digits.

In the spirit of compromise, I am willing to pay this account IN FULL (or settlement percentage) if you agree to immediate deletion of this account from any and all credit reporting agencies (Equifax, Experian and TransUnion). The purpose of this settlement is merely to have this item removed from my credit files. It is not to be construed as an acknowledgment of liability for this debt in any form.

If you agree to the terms and accept this agreement, certified funds for the settlement amount of twenty-five dollars ($25.00) will be sent to Collection Agency in exchange for full deletion of ALL references regarding this account from my credit files and full satisfaction of the debt. As certified funds will be used for payment, there shall be no waiting period regarding the deletion of this account from the credit reporting agencies.

Collection Agency agrees to delete ALL information regarding this account from the credit reporting agencies WITHIN TEN CALENDAR (10) DAYS following receipt of payment as specified above and will not discuss the terms of this settlement with anyone, excluding your client on this account. If contacted by any third party, including credit-reporting agencies, Collection Agency will not acknowledge that any settlement offer was made, accepted or executed and will, in fact, deny knowledge of any such account.

If you agree to the above terms, please prepare a letter on your company letterhead explicity agreeing to the same terms as the above settlement offer and have it signed by an authorized representative of Collection Agency. It will be implied that this letter shall constitute a legally binding contract, enforceable under the laws of my state.

Your response must be postmarked no later than 15 days from your receipt of this settlement offer or this offer will be withdrawn and I will request full validation of this alleged debt, as provided for by the Fair Debt Collection Practices Act.

Please address all correspondence regarding this account to:

Ok  I have some accounts from Peoples Energy in Chicago.  I CMRRR'd a goodwill letter asking that the account be removed from my file since they have been paid.  I rec'd the green card and am waiting for a reponse.  The account has been paid and I was wondering if this letter will work for me or shoud I keep trying to send GW letters asking for the lates to be removed?  I sent the GW to the general address, no one in particular.  Is there anyone that I should try to sent it to if I do not receive a positive response?  All of these lates are having a neg. impact on my scores.  Any suggestions?

Re: PFD Example Letter

Advice...

Can I PFD a CA for a credit union? Has anyone done this before.  I have a loan that is in good standing with them but I also owe for an old bank account that closed and still had a balance.

I think the name of the CA is Conserve.  But funny enough- they havent bothered me about it in so long and it may fall off.  I am trying to remember my last payment to them.  Lemme go run and look now..
